HomeMy WebLinkAboutRES 86-018 R E S O L U T I O N WHEREAS, Gulf States Utilities Company has filed its Statement of Intent with the City to increase its rates for electric utility service within the City; and, WHEREAS, Gulf States Utilities Company has filed simultaneously a Statement of Intent with the Public Utility Commission of Texas to increase said rates, in which such proceeding the City has intervened; and, WHEREAS, Section 23 of the Public Utility Regulatory Act compels municipalities acting in a regulatory authority to make a reasonable determination of reasonable rates of utilities and to retain any and all personnel necessary therefor; and, WHEREAS, Section 24 of the Public Utility Regulatory Act authorizes the governing body of the City to select and engage rate consultants, accountants, auditors, attorneys, engineers, or any combination thereof, to conduct investigations, present evidence, advise and represent the governing body in such proceedings and requires the Public Utility engaged in such proceedings to reimburse the City for the reasonable cost of such services; and, WHEREAS, Section 29 of the Public Utility Regulatory Act provides that authorized agents of any regulatory authority shall have certain rights of inspection and to obtain information from the utility in question; and, WHEREAS, Gulf States Utilities Company has requested exceptional rate relief through the inclusion of construction work a Iry in progress in its rate base, which such inclusion is permissible only to the extent that any such project has been efficiently and prudently planned and managed; and, WHEREAS, the firm of O' Brien-Kreitzb erg & Associates, Inc. , should be engaged to act in all respects for the City pursuant to the above-referenced provisions of the Public Utility Regulatory Act and, without limitation because of the foregoing enumeration, all other provisions of the Public Utility Regulatory Act; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: Section 1 . The firm of O 'Brien-Kreitzb erg & Associates, Inc. , is hereby engaged by the City, pursuant to Section 24 of the Public Utility Regulatory Act, to perform all necessary duties thereunder for the City in connection with the rate increase application filed by Gulf States Utilities Company with the City and the Public Utility Commission of Texas. Section 2 . -Gulf States Utilities Company shall reimburse the City for the reasonable cost for such services to the extent found reasonable by the applicable regulatory authority. Section 3 . The firm of O' Brien-Kreitzberg & Associates, Inc. , and any member, principal or employee of such firm is hereby designated as an agent of the City under Section 29 of the Public Utility 2 - Regulatory Act with all rights thereunder, which such section is hereby made reference for all purposes as though copied herein in full. Section 4 . Gulf States Utilities Company shall provide all information requested by O'Brien-Kreitzb erg & Associates, Inc. , or any member, principal or employee of such firm, or any subcontractor thereof, on a timely basis and shall allow all such parties to have the right, at reasonable times, and for the purposes of said rate proceeding, particularly as they relate to the River Bend Nuclear Project, to inspect and obtain copies of the papers, books, accounts, documents, and other business records, and to inspect the plant, equipment, and other property of Gulf States Utilities Company. It is the purpose of this section to provide to O'Brien-Kreitzb erg & Associates, Inc . , and any member, principal or employee thereof, or any subcontractor thereof, with all authority to act as an agent for the City under said Section 29 of the Public Utility Regulatory Act and any other applicable section as through said section or sections were copied herein in full. Section 5 . The City Attorney and special utility Counsel shall take all necessary steps to effect the intent of this resolution.
