HomeMy WebLinkAboutRES 85-291 'AS-.2 91 R E S O L U T I O N WHEREAS, on September 8, 1981 City Council awarded a contract to Kohler & Kohler Engineers for engineering services for the design and construction of the Phelan Boulevard Extension; and, WHEREAS, on October 27, 1982, bids were received for the construction of the Phelan Extension with the contract being awarded to Troy Dodson Construction Company; and, WHEREAS, on November 2, 1982, the City Council awarded the contract to Troy Dodson Construction Company in the amount of $3, 259,018.75 with two hundred twenty ( 220) working days to complete the project; and, WHEREAS, the Notice to Proceed was given on November 30, 1982 making the completion date, with consideration given for rain and delay days, May 16, 1984; and, WHEREAS, on November 1 , 1984, the contractor, Troy Dodson Construction Company, was finally removed from the project for failure to comply with orders to perform a number of repairs for opening of traffic, as well as failure to comply with the project specifications in both quality of work and timely completion of the project; and, WHEREAS, at that time the Contractor had used in excess of three hundred (300) working days and liquidated damages in the amount of $23,000 were assessed to the contractor for time. delays and five percent (5%) retainage in the amount of $167,054.22 has been withheld from payments to the Contractor making the total withholding amount $190,054.22; and, WHEREAS, on May 3 , 1985, City Council authorized payment of $21, 999.82 to Kohler & Kohler for additional inspector working days in excess of a reasonable time for construction; and, WHEREAS, with the Contractor removed from the project, there still remains a number of repairs to be completed before the project will meet City standards which will cost approximately $161,000 and will be fined from the withholdings from Troy Dodson Construction Company; and, WHEREAS, the staff has requested a proposal from Kohler & Kohler Engineers, because of their familiarity with the project, for providing plans and specifications along with inspection services for the Phelan Extension repairs; and, WHEREAS, the contract will consist of two ( 2) phases, the design phase and the construction phase with a total not-to-exceed amount for the Engineering Services Contract of $28, 300; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby, authorized to execute an engineering services contract with Kohler & Kohler Engineers for the Phelan Boulevard Extension Project at a not-to-exceed amount of $28, 300.
