WHEREAS, on September 8 , 1981 , the City Council authorized
the City Manager to execute a contract with Kohler & Kohler Engineers
for engineering services in relation to the design and construction
of the Phelan Boulevard Extension Project for a not-to-exceed fee of
$280,000 ; and,
WHEREAS, on November 2 , 1982, the City Council authorized
the City Manager to execute a contract with Troy Dodson Construction
Company in the amount of $3 ,259,018 .75 for construction of the Phelan
Boulevard Project with two hundred twenty ( 220) working days; and,
WHEREAS, on November 1 , 1984, -Troy Dodson Construction
Company was removed from the project for failure to comply with
orders to perform repairs for opening of traffic, as well as general
failure to comply with the project specifications and had used in
excess of three hundred (300) working days; and,
WHEREAS, liquidated damages have been assessed to the
contractor in the amount of $23,000 for time delays and overruns;
and,
WHEREAS, on November 26, 1984, the City received
notification from Kohler & Kohler requesting $21,999.82 in additional
compensation because the company had to provide inspection services
in excess of a reasonable time for construction contending that the
contractor' s project management procedures were beyond his control;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT, after review of Kohler & Kohler' s request, the City Manager be,
and he is hereby, authorized to pay Kohler & Kohler Engineers
$21,999.82 for additional services rendered in relation to the Phelan
Boulevard Extension Project.
