R E S O L U T I O N
WHEREAS, the firm of Orgain, Bell & Tucker has been
retained to represent the City of Beaumont in its efforts to recover
its losses presently at risk resulting from the United States
Government Securities fraud perpetrated by E.S .M. Government
Securities, Inc. ; and,
WHEREAS, the City Council wishes, as part of such
representation, to have Orgain, Bell & Tucker engage an investigator
who is familiar with municipal management, law and practices to
report to the Council on the question of how the potential loss
occurred based on an investigation of the internal policies
procedures and activities of the City and its employees; and,
WHEREAS, Orgain, Bell & Tucker should perform this
investigation by taking all its direction from the City Council and
shall remain, as to this investigation, completely independent from
City staff;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the Mayor be, and he is hereby, authorized to engage the law
firm of Orgain, Bell & Tucker, as a part of its representation of
the City of Beaumont, to retain an independent investigator to work
for Orgain, Bell & Tucker under the charge of the City Council, and
for the purposes set out above.
PASSED BY THE CITY COUNCIL of the City of Beaumont this
the day of 1985.
