HomeMy WebLinkAboutRES 85-079 R E S O L U T I O N WHEREAS, the parcels of land described in the general warranty deeds attached hereto as Exhibit "A" were originally acquired for Buford and Carroll Street right-of-way purposes and the Missouri Pacific Relocation Project and are no longer needed by the City of Beaumont; and, WHEREAS, said parcels of land, because of their size and shape, are incapable of being used independently as zoned and are uneconomic remnants and should be sold to the abutting property owners; and, WHEREAS, the abutting property owners are Joe E . O' Fiel for parcel #1 , 0 .38 acres out of Lots 19 and 20, Thurlow Court Addition, and Oscar Sims for parcel #2 , 2300.0 square feet out of City Tax Tract 25, Plat "N" , David Brown Leage, Abstract 5 , both of Beaumont, Jefferson County, Texas; and, WHEREAS, Joe E. O' Fiel and Oscar Sims have agreed to pay the City of Beaumont $1 ,200 and $4 ,500, respectively, for said property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby, authorized to execute, for and in behalf of the City of Beaumont, general warranty deeds in substantially the form attached hereto as Exhibit "A" and in consideration of $1 ,200 and $4 ,500, respectively. Mayor - 2 - STATE OF TEXAS X KNOW ALL MEN BY THESE PRESENTS: COUNTY OF JEFFERSON X WARRANTY DEED THAT the City of Beaumont, a municipal corporation of Jefferson County, Texas, for and in consideration of the sum of FOUR THOUSAND FIVE HUNDRED AND N01100 DOLLARS ($4,500.00) and other good and valuable consideration paid by the GRANTEE herein named, the receipt and sufficiency of which are hereby acknowledged and confessed, has GRANTED, SOLD, and CONVEYED, and by these presents does hereby GRANT, SELL, and CONVEY unto Oscar Sims of Beaumont, Jefferson County, Texas, subject to the reservations hereinafter made, all of that certain real estate (the. "Property") lying and being situated in Jefferson County, Texas, more particularly described as follows, to-wit: That certain U.35U acre tract of land being a part of the Charles Williams League, Abstract 59, Jefferson County, Texas, also being a part of Lots 19 and 20 of Thurlow , Court Addition, a subdivision within the City of Beaumont, Jefferson County, Texas; said Thurlow Court Addition being described by a plat recorded in Volume 5, Page 111 of the Jefferson County Map Records; said 0.350 acre tract being more particularly described by metes and bounds as follows; BEGINNING at a point located at the southwest corner of Lot 18 of the said Thurlow Court Addition, and the northwest corner of said Lot 19; said point also being on the easter]y' right-of-way line of Marceline Boulevard, a 50.00 foot 'wide -right-of-way; said point being the northwest corner of the said 0.350 acre tract; THENCE North 89 degrees 10 minutes 00 seconds East along the south line of said Lot 18 and the north line of said Lot 19, a distance of 165.40 feet to a point at the southeast gorner of said Lot 18 and the northeast corner of said Lot 19; said point also being the northeast corner of the said 0.350 acre tract; THENCE South OU degrees 50 minutes 00 seconds East along the east line of said Lot 19, a distance of 89.13 feet to a point on the northerly right-of-way line of the Missouri Pacific Railroad Company right-of-way; said right-of-way conveyed to the Missouri Pacific Railroad Company from the City of Beaumont by deed recorded in Volume 1245, Page 351 of the Jefferson County Deed Records; said point also being the southeast corner of the said 0.350 acre tract; THENCE South 81 degrees 25 minutes UO seconds West along the said northerly line of the Missouri Pacific Railroad Company right-of-way, a distance of 213.76 feet to a point of curvature in the said northerly line of the Missouri Pacific Railroad right-of-way; py THENCE continuing in a westerly direction along the said northerly line of the Missouri Pacific Railroad right-of-way described by a curve to the right with a 2,814.75 foot radius and a central angle of OU degrees U5 minutes 03 seconds, an arc length of 4.14 feet to a point located on the westerly line of said Lot 20; said point also being on the easterly line of Lot 21 out of the Thurlow Court Addition; said point also being the southwest corner of the said 0.350 acre tract; THENCE; North OU degrees 5U minutes 00 seconds West along the said east line of Lot 21 and the said west line of Lot 20, a distance of 12.01 feet to a point on the Marceline. Street cul-de-sac lUO foot diameter right-of-way line; THENCE in an easterly direction along the said Marceline Street cul-de-sac right-of-way line described by a curve to the left with a 50-toot radius and a central angle of 180 degrees 00 minutes 00 seconds, an arc length of 157.08 feet to a point on the westerly line of said Lot 19; THENCE North 00 degrees 50 minutes 00 seconds West along the said westerly line of Lot 19 and the said easterly right-of-way line of Marceline Street, a distance of 20.00 feet to the POINT OF BEGINNING, and containing. 0.350 acres of land. This conveyance is expressly subject to all zoning laws and to restrictions, covenants, conditions, easements and mineral and/or royalty reservations affecting said property, if any. The City of Beaumont hereby specifically reserves the southerly most forty (401 ) feet of the herein described tract of land for a drainage and general utility easement, the south line of the said easement also being the north line of the Missouri Pacific railroad right-of-way. TO HAVE AND TO HOLD the Property, together with all and singular the rights and appurtenances thereto in any wise belonging unto the said Oscar Sims, his heirs, successors, and assigns forever, and GRANTOR does hereby bind itself and its heirs, successors, and assigns, to warrant and forever defend all and singular the Property unto Grantee and his heirs, successors, and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof, by, through or under, but not otherwise and subject to all easements and reservations of minerals of record. O'Fiel of Beaumont, Jefferson County, Texas, subject to the reservations hereinafter made, all of that certain real estate (the "Property") lying and being situated in Jefferson County, Texas, more particularly described as follows: BEING a 2300.0 square foot tract of land out of City Tax Tract 25, Plat "N", being situated in the David Brown League in the City of Beaumont, Jefferson County, Texas and further described in .a deed from American National Bank to the City of Beaumont, recorded in Volume 2203, page 11 of the Deed Records of Jefferson County, Texas, said tract being more particularly described by metes and bounds as follows: BEGINNING at a point South 89 degrees 27 minutes West 220.0 feet from the intersection of the west line of Turon Street with the existing south line of Buford Street, also being the northeast corner of the herein described parcel of land; THENCE South 89 degrees 27 minutes West for a distance of 40 feet to a point for corner; THENCE South 57 degrees 32 minutes West for a distance of 47.29 ,feet to a point for corner; '.THENCE South 00 degrees 14 minutes East for a distance of 10 feet to a point for corner; THENCE North 89 degrees 27 minutes East a distance of 80 feet to a point for corner; THENCE North 00 degrees 14 minutes West for a distance of 35 feet to the PLACE OF BEGINNING, containing 2300.0 square feet of land, more or less. This conveyance is expressly subject to all zoning laws and to restrictions, covenants, conditions, easements and mineral and/or royalty reservations affecting said property, if any.
