WHEREAS, on February 7 , 1984 the City Council passed
Resolution No. 84-48 authorizing the City Manager to execute an
agreement with the State Department of Highways and Public
Transportation for the construction, maintenance and operation of a
safety lighting system on U. S. 69 from Lawrence Drive to Pine
Island Bayou; and,
WHEREAS, we have been informed by the State that this
project was identified as a safety lighting system in order to be
eligible for federal funding and that the proposed system to be
installed is a continuous lighting system, i.e. , lighting for a
section of roadway rather than a safety lighting system, i.e . ,
lighting at specific locations such as entrance or exit ramps;
NOW , THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT Resolution No. 84-48 passed February 7 , 1984 be, and the same
is hereby, rescinded.
BE IT FURTHER RESOLVED that the agreement entered into
with the State Department of Highways and Public Transportation for
the construction, maintenance and operation of a safety lighting
system on U. S. 69 from Lawrence Drive to Pine Island Bayou be, and
it is hereby , cancelled and a new agreement be executed for the
construction, maintenance and operation of a continuous lighting
system on U. S. 69 from Lawrence Drive to Pine Island Bayou.
