HomeMy WebLinkAboutRES 84-192 jq R E S O L U T I O N BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby , authorized to execute a one year contract providing for the payment to the City of Beaumont of One Thousand Nine Hundred Fifty-Nine Dollars ( $1 ,959) by the City of Bevil Oaks to provide emergency medical services to Bevil Oaks. PASSED BY THE CITY COUNCIL of the City of Beaumont this n the `J�i�� day of _4�� , 1984. - Mayor - CONTRACT THE STATE OF TEXAS COUNTY OF JEFFERSON WHEREAS, the City Council of the City of Beaumont by resolution has authorized its City representative, the City Manager, to execute a one-year contract with the City of Bevil Oaks to provide emergency medical services to Bevil Oaks; and, WHEREAS, emergency medical services are to be provided by employees of the City, formerly known as the Beaumont Emergency Medical Services Corporation, a Texas nonprofit corporation; now therefore: THIS AGREEMENT, made and entered into this day of , 1984, by and between the City of Beaumont, a municipal corporation of the State of Texas, hereinafter called "City, " acting herein by and through its duly authorized City representatives, and the City of Bevil Oaks, a municipal corporation of the State of Texas, hereinafter called "Bevil Oaks, " acting herein by and through its duly authorized City representatives. W I T N E S S E T H 1 . City shall provide emergency medical services for the sick , injured, afflicted or disabled persons under emergency conditions within Bevil Oaks. City does hereby agree to accept such engagement and employment and to discharge such duties in accordance with the terms and conditions herein set forth. 2 . City shall provide emergency medical services to Bevil Oaks when requested and as personnel and equipment are available to respond to said requests; however, City shall use due diligence to provide prompt response to said requests. Requests for transportation of nonemerge ncy patients will not be accepted. 3 . Bevil Oaks shall pay to City for emergency medical services. The total contract amount to be paid by Bevil Oaks during term of this one ( 1 ) year contract is ONE THOUSAND NINE HUNDRED FIFTY-NINE DOLLARS ( $1 ,959) . 4 . Bevil Oaks shall provide at its own costs insurance with the following limits: general public liability , including contractual coverage, limit FIVE HUNDRED THOUSAND DOLLARS ( $500,000) ; property damage liability , limit FIFTY THOUSAND DOLLARS ($50,000.00) ; automobile bodily injury liability and property damage liability covering operations of emergency vehicles; bodily injury liability not less than TWO HUNDRED THOUSAND DOLLARS ($200,000) each accident; property damage not less than TWENTY FIVE THOUSAND DOLLARS ($25,000) each accident and FIFTY THOUSAND DOLLARS ($50,000) aggregate; the policy or policies issued hereunder shall name City as an additional insured and shall contain a provision that the policy shall not be canceled, expire or otherwise be terminated until after thirty ( 30) days written notice to that effect is given to City. Bevil Oaks shall furnish City with proof of insurance. 5 . Bevil Oaks hereby agrees to indemnify and save harmless the City from any and all claims, causes or action, and damages of every kind, for injury to or death of any person and damage to property which might arise as a result of joint or several acts, omissions or negligence of City and Bevil Oaks or their employees or agents. 6. Bevil Oaks shall comply with all laws applicable to its activities. 7 . This agreement shall be deemed to be made and shall be construed in accordance with the laws of the State of Texas and shall be performable in Jefferson County, Texas. 8 . Either party may terminate this agreement by giving sixty (60) days written notice to the other party. In the event this 2 - contract is terminated by either party , the contract amount provided for in paragraph 3 above shall be prorated to the date of termination. 9 . All notices required to be given hereunder by City to Bevil Oaks shall be in writing by mail or telegram, postage prepaid, and addressed to Bevil Oaks as follows: City of Bevil Oaks H. C . Davidson, Mayor Bevil Oaks, Texas All notices required to be given hereunder by Bevil Oaks to City shall be in writing by mail or telegram, postage prepaid, and addressed to City of Beaumont as follows: Karl Nollenberger City Manager City of Beaumont P. O. Bo 3827 Beaumont, Texas 77704 10. Terms of this agreement shall be in force from the day of 1984 until the day of 1985. EXECUTED in duplicate originals this day of 1984.
