BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby , authorized to execute
an agreement with Mrs. Carol Tyrrell Kyle accepting the donation of
Fifty Thousand Dollars ( $50,000) for an acoustical shell for the
Julie Rogers Theatre for the Performing Arts and authorizing the
purchase of such shell at a price not to exceed Seventy Thousand
Dollars ( $70, 000) .

AGREEMENT
STATE OF TEXAS
COUNTY OF JEFFERSON §
WHEREAS, Carol Tyrrell Kyle wishes to contribute a portion
of the cost of an acoustical shell to be used at the Julie Rogers
Theatre for the Performing Arts; and,
WHEREAS, in reliance upon such contribution the City
desires to purchase such acoustical shell;
NOW , THEREFORE, the parties agree as follows:

1 .
Carol Tyrrell Kyle hereby agrees to donate to the City of
Beaumont the total amount of $50,000, with $25,000 to be paid to
the City of Beaumont during calendar year 1984 and a like sum to
be paid during calendar year 1985.
2 .
The City of Beaumont agrees to purchase an acoustical shell
to be used at the Julie Rogers Theatre for the Performing Arts.
The purchase by the City of Beaumont is contingent upon obtaining
a price for such acoustical shell not to exceed $70,000. City
will use its best efforts to purchase such acoustical shell at
such price on or before September 1 , 19841. of
