HomeMy WebLinkAboutRES 84-170 7© R E S_O L U T _I O N BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby , authorized to execute a "Memorandum of Understanding" with the Department of the Army for use of Fair Park as a marshalling area during a mobilization in a national emergency in the form attached hereto as Exhibit "A" . PASSED BY THE CITY COUNCIL of the City of Beaumont this the A—'O' day of --- /,�'7Q.c 1984. bAA\ C Mayor - until the operation of a marshalling area in support of the Seaport of Embarka- tion, Beaumont, ceases. Upon expiration of such necessity, the Army use of City of Beaumont land and improvements included in this agreement will be restored to the City. Estimated duration of use is 30 to 120 days. 6. COSTS: The Army shall be permitted to use the land and improvements included in this agreement without cost to the United States except that any and all direct expenses and costs to the City of Beaumont generated by the operation of the marshalling area (e.g. electricity, water, liquid and solid waste disposal, etc.) will be reimbursed by the Army to the City. Upon expiration of such use by the Army, the land and improvements will be restored to the City in the same or better condition as existed at the beginning of said use by the United States Army. 7. PERSONNEL AND EQUIPMENT: The Army will have the right to place on the land and in or on the facilities included in this agreement, personnel, equipment, materials, temporary structures and other non-real property determined by the Army as being necessary to the operation of the marshalling area. Title to such Government property to remain vested in the Army at all times. 8. EXCLUSIONS: a. During a 10-day period in mid-October each year the Southeast Texas Fair is held in Fair Park and Arena. Cooperation and coordination between the officials of the City of Beaumont and the representatives of the United States Department of Army will be employed in an effort to circumvent use of the marshalling area during that period if at all possible with the understanding that the national emergency takes precedence. b. The following facilities at Fair Park are not available for use by the United States Army: (1) Beaumont Little Theater (2) Harvest Club (3) Young Men's Business League (under lease to private organization) (4) Art Museum 2 IN WITNESS WHEREOF, the City of Beaumont, Texas, and the Department of the Army have caused this agreement to be executed on the dates set out herein. CITY OF BEAUMONT, TEXAS By: KARL NOLLENBERGER, CITY MANAGER (NAME AND TITLE) DATE CONDITIONS ACCEPTED: UNITED STATES DEPARTMENT OF THE ARMY By: SECRETARY OF THE ARMY DATE 3 MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF BEAUMONT, TEXAS AND THE DEPARTMENT OF THE P.RhIY 1%T1EREAS, the United States Army has need for a marshalling area near the Beaumont Seaport during a mobilization in a national emergency; *EREAS, a portion of the Fair Park and Arena, City of Beaumont, Texas, has been identified as meeting the requirements for subject marshalling area; NOW THEREFORE, the City of Beaumont and the United States Army hereby agree that a portion of Fair Park and Arena, Beaumont, Texas, may be used by the Army for a marshalling area during mobilization in a national emergency for the purposes and subject to the conditions set out below: 1. PURPOSE: To provide use of a portion of Fair Park, Beaumont, Texas, by the United States Army during periods of national emergency. 2. ESTATE: A certain portion of Fair Park and Arena, City of Beaumont, Beaumont, Texas, as identified on plat at Exhibit A, has been identified as a marshalling area in support of the Seaport of Embarkation (SPOE) Beaumont, Texas, during mobilization at the time of a national emergency. 3. SCOPE: This memorandum and agreement covers the part of Fair Park and Arena, City of Beaumont, Beaumont, Texas, identified on plat at Exhibit A, attached hereto and made a part hereof. 4. EFFECTIVE DATE OF AGREEMENT: This agreement shall be effective on the date it is fully executed by both parties and remain in effect until 30 days after written notice of revocation is given by either party, provided that the agreement cannot be revoked during a period of mobilization due to a national emergency. S.
