HomeMy WebLinkAboutRES 84-164 R E S O L U T I O N WHEREAS, the parcel of land described in the general warranty deed attached hereto as Exhibit "A" was originally acquired for street right-of-way purposes and is no longer needed by the City of Beaumont; and, WHEREAS, said parcel of land, because of its size and shape, is incapable of being used independently as zoned and is an uneconomic remnant and should be sold to the abutting property owner; and, WHEREAS, the abutting property owner is Bill Folmar, Trustee, of Beaumont, Jefferson County , Texas; and, WHEREAS, Bill Folmar, Trustee, has agreed to pay the City of Beaumont $5,000. 00 for said property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT : THAT the City Manager be, and he is hereby , authorized to execute, for and in behalf of the City of Beaumont, a general warranty deed in substantially the form attached hereto as Exhibit "A" and in consideration of $5,000. 00. Mayor - THE STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS: COUNTY OF JEFFERSON GENERAL WARRANTY DEED THAT the City of Beaumont, a municipal corporation of Jefferson County, Texas, for and in consideration of the sum of FIVE THOUSAND AND NO/100 DOLLARS ($5 ,000. 00) and other good and valuable consideration paid by the GRANTEE herein named, the ,4, receipt and sufficiency of which are hereby acknowledged and confessed, has GRANTED, SOLD, and CONVEYED, and by these presents does hereby GRANT, SELL, and CONVEY unto Bill Folmar, Trustee, of Jefferson County, Texas, all of that certain real estate ( the "Property" ) lying and being situated in Jefferson County , Texas, more particularly described as follows: Being a tract of land out of Lots 1 and 2 , Block "E" of the T . H. Langham Estate Subdivision as recorded in Volume 4 , Page 86, of the Map Records of Jefferson County , Texas, said tract of land being a part of that tract of land conveyed to the City of Beaumont by Marie B . Weir, et al, by deed dated January 10, 1959 and recorded in Volume 1146, Page 338 of the Deed Records of Jefferson County , Texas and being more particularly described by metes and bounds as follows: FOR LOCATIVE CORNER, begin at the southeast corner of said Lot 1 at the point where the east line of said Lot 1 and the north line of the railroad right-of-way intersects, said point also being on the west right-of-way line of Langham Road and the southeast corner of a said tract of land conveyed to City of Beaumont; THENCE north 02 016105" west along the west right-of-way line of Langham Road and the east line of a 40 foot drainage easement as conveyed to Drainage District No. 6 by the City of Beaumont dated April 30, 1984, a distance of 40. 18 feet to an iron rod at the most southeast corner of the Marie B . Weir, et al tract; THENCE south 82014' 00" west along the north line of said drainage easement a distance of 116. 01 feet, more or less, to an iron rod for corner and the PLACE OF BEGINNING, as surveyed by Fittz , Crozier and Shipman of the 6 . 223 acre tract, 12-11-80 ; THENCE north 07 046100" west a distance of 40 feet to an iron rod for corner; THENCE south 82 014100" west along the south line of the said Weir, et al tract and the north line of the said City of Beaumont tract a distance of 514. 43 feet to an iron rod for corner; Exhibit "A" THENCE south 00019129" east along the east line of a 40. 34 foot Jefferson County Drainage District No . 6 easement as recorded in Volume 999 , Page 430 of the Deed Records for a distance of 40. 6 feet to a point for corner in the north line of the said 40.0 foot drainage easement and the southwest corner of Lot 2 , Block E of the said T. H. Langham Estate Subdivision; THENCE north 82114100" east along the north line of the said 40. 0 foot drainage easement and the south line of said Lots 1 and 2 , Block "E" for a distance of 519. 65 feet to the PLACE OF BEGINNING. This conveyance is expressly subject to all covenants, restrictions, and easements of record affecting said Property , if any. TO HAVE AND TO HOLD the Property , together with all and singular the rights and appurtenances thereto in any wise belonging unto the said Bill Folmar, Trustee, his heirs, successors, and assigns forever, and GRANTOR does hereby bind itself and its heirs, successors, and assigns, to warrant and forever defend all and singular the Property unto GRANTEE and his heirs, successors, and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof, by, through or under, but not otherwise and subject to all easements and reservations of minerals of record.
