HomeMy WebLinkAboutRES 83-432 R E S O L U T I O N WHEREAS, the City of Lumberton requested permission from the City of Beaumont to annex property lying within the extraterritorial jurisdiction of the City of Beaumont; and, WHEREAS, the City of Beaumont granted permission to the City of Lumberton for such annexation by Resolution 82-409 passed November 2 , 1982 ; and, WHEREAS, permission was effective only if annexation of the property by the City of Lumberton was completed on or before November 30, 1983 ; and, WHEREAS, the City of Lumberton has requested an extension to complete annexation of such property; and, WHEREAS, the City of Beaumont desires to grant such extension; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the City of Beaumont hereby grants written permission for annexation of the property described in Exhibit "A" attached hereto and made a part hereof by the City of Lumberton. The permission granted hereby shall be effective only if annexation of the property by the City of Lumberton occurs on or before December 20, 1983. BE IT FURTHER RESOLVED that a certified copy of this resolution shall serve as proof of the written permission of the City //- :2.;2 -d3 of Beaumont for the annexation of the above-described property by the City of Lumberton. PASSED BY THE CITY COUNCIL of the City of Beaumont this the 9 } day of Mayor - 2 - Field notes of approximately five and one tenth (5.1 ) square miles for annexation to incorporation of the City of Lumberton: BEGINNING at the southwest corner of the Lumberton city limits; THENCE in a southeasterly direction parallel to and 200 feet from the west right-of-way line of U. S. Highway 69/287 to the north line of Lumberton Independent School District tract , as recorded in Volume 661 , page 141 Deed Records, Hardin County, Texas. THENCE south 630 22 ' west , 1546.72 feet with the north line of the said Lumbrton Independent School District tract to the northwest corner of the said Lumberton tract , a concrete monument with a metal disc in top stamped "L. I.S .D . Tr. F. Arriola Kirby 1 - 1230" ; THENCE south 360 57 ' north, 1662.58 feet with the west line of the said Lumberton School tract to the southwest corner of said Lumberton School tract , a concrete monument with a metal disc in top stamped "L.I .S.D. Tr. F . Arriola Kirby 1-1229" ; THENCE north 630 22 ' east , 1248.97 feet with the south line of the said Lumberton school tract to a point 200 feet perpendicular from the west right-of-way line of U. S . Highway 69/287 said point being south 630 22 ' west , 200 feet from the southeast corner of the Lumberton School tract and said southeast corner being north 260 38 ' west , 813 .84 feet from the R. C . Rogers League west line and F. Arriola League east line and being north 000 32 ' west , 925.60 feet from a concrete monument with a metal disc stamped "F . Arriola - Ell Cor Kirby 1-232" in east line of F. Arriola League Abstract-2 and west line of R. C . Rogers League Abstract - 46 ; THENCE southeasterly parallel to and 200 feet from the west of the north right-of-way line of F.M. 421 ; THENCE southwesterly parallel to and 200 feet from the north right-of-way line of F.M. 421 to the northern extention of the east line of the City of Beaumont tract ; THENCE southeasterly to the southeast corner of the said City of Beaumont tract ; THENCE southwesterly with the southline of the City of Beaumont tract to the southwest corner of the said tract in the east right- of-way line of the Texas and New Orleans R .R. ; THENCE southeasterly with the east right-of-way line of the Texas and New Orleans R.R. to the north line of the James Kilgore survey; THENCE west with the north line of the James Kilgore to the north- west corner of the James Kilgore and northwest corner of the Lumberton Little League 16.13 acre tract as recorded Volume 561, page 207 , Deed Records, Hardin County, Texas ; THENCE south with the west line of the James Kilgore 814.20 feet to the southwest corner of the Lumberton Little League tract; THENCE east with the south- line of the Lumberton Little League tract at 779.12 feet the most westerly southeast corner of Lumberton Little League tract and continuing at 1163 feet to the west right-of-way of the Lumberton Little League 50 foot road ; THENCE southeasterly 775 feet with the west line of the Lumberton Little League road continuing to the southwest corner of the said 50 foot road ; THENCE southeasterly to the southwest corner of El Pino Section two ; THENCE northeasterly with the south line of El Pino Section two I to the southeast corner of the said subdivision; , THENCE easterly to the southwest corner of Lindsey Road ; THENCE east with south right-of-way of Lindsey Road cross U. S . Drake tract in the east right-of-way Old Silsbee Highway; THENCE westerly to a point 200 feet north of East Walton Road and 200 feet east of the east right-of-way U. S. Highway 96 ; THENCE northerly parallel to and 200 feet from the east right- of-way line of U. S . Highway 96 to the north line of Village Creek; THENCE northwesterly following the meanders of the north line of Village Creek to the intersection with the easterly extended northern line of the Shangrila Subdivision; THENCE northwesterly to the northeast corner of the Charles Stanley tract ; THENCE northwesterly to the most easterly southeast corner of Brushy Creek Estates; THENCE north to the north line of the A. E n annexation boundary -- 4 4 a subject territory. on.Inn t Gun CIVD I- LSs � LA,.w • I I ` I Beaumont Proposed Annexation by Lumberton -�� - S2 - /4/-3 � R E S O L U T I O N BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby , authorized to execute an agreement between the City of Beaumont and Washington West Limited, developer, for the participation of the city in the paving of Whitson' s Way from Washington Boulevard southeasterly for a distance of approximately 615 feet in accordance with the city' s participation paving policy at a cost to the city of approximately $36,479, including engineering services. BE IT FURTHER RESOLVED that the City Manager be, and he is hereby , authorized to execute an agreement between the City of Beaumont and Fittz , Crozier and Shipman, Consulting Engineers, for the necessary engineering service for the above project.
