WHEREAS, the State Highway and Public Transportation
Commission passed Minute Order No. 73282 , dated August 31 , 1977 and
Minute Order No. 73567 dated October 21 , 1977 , which provided for
the City of Beaumont to negotiate the acquisition of right of way
for the improvement of Spur 380 in the State' s name; and,
WHEREAS, the City of Beaumont accepted Commission Minute
Order No. 73282 and Minute Order 73567 by Resolution R-77-350 , dated
November 22, 1977; and,
WHEREAS, the City of Beaumont acquired a 0 .1036 acre tract
of land in the name of the City of Beaumont and the State of Texas
from Church' s Fried Chicken, Inc. , by judgment dated September 10 ,
1982 , and recorded in Volume 2415, Page 234 , Deed Records of
Jefferson County, Texas; and,
WHEREAS the City of Beaumont desires to correct said error
by conveying the City of Beaumont' s interest in said 0 . 1036 acre
tract of land to the State of Texas;
NOW , THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager is hereby authorized and directed to convey
the City of Beaumont' s interest in and to said 0 . 1036 acre tract of
land to the State of Texas;
BE IT FURTHER RESOLVED that this Resolution shall take
effect immediately from and after its passage; and,
BE IT FURTHER RESOLVED that the City Clerk of the City of
Beaumont be authorized to furnish a certified copy of this
resolution to Mr. F . C . Young, District Engineer, State Department
of Highways and Public Transportation.

THAT the City of Beaumont of the County of Jefferson,
State of Texas, hereinafter referred to as Grantors, for and in
consideration of the sum of ONE AND N01100 ($1 .00 ) DOLLAR, and
other good and valuable consideration to Grantors in hand paid by
the Grantee herein named, the receipt of which is hereby
acknowledged, and for which no lien is retained, either expressed
or implied, have QUITCLAIMED, and by these presents do QUITCLAIM,
unto the State of Texas, all of Grantors ' right, title and interest
in and to the following described real property situated in
Jefferson County, Texas, to-wit:
Being 0 .1036 acre of land, more or less, being
out of and a part of Lots No. 14 and 15, Block
No. 5 , Arlington Addition, to the City of
Beaumont, Texas in the David Brown League,
Abstract No. 5 , Jefferson County , Texas
according to a map or plat of said addition
recorded in Volume 1 , Page 70 , Map Records,
Jefferson County, Texas, said Lots No. 14 and 15
were conveyed to Church' s Food Service
Industries, Inc. by Deed dated November 15 , 1967
and recorded in Volume 1526 , Page 231 , Deed
Records, Jefferson County, Texas, said 0 .1036
acre tract being more particularly described by
metes and bounds as follows:
Commencing at the Southwest corner of said Lot
No. 14, Block No. 5 of the said Arlington
Addition, Thence North 77 051 ' 41 .06" East along
the South line of said Lots No. 14 and 15, a
distance of 77.57 feet to the POINT OF BEGINNING
of the tract herein conveyed;
THENCE North 12 025' 24 . 19" West along the proposed
West right of way line of Highland Avenue, a
distance of 95.00 feet to a point for corner;
THENCE North 57016 ' 51 .57" West along the proposed
West right of way line of Highland 'Avenue, a
distance of 63 .80 feet to a point for corner in
the North line of said Lot No. 14 ;
THENCE North 77 051 ' 41 .06" East along the North
line of said Lots No. 14 and 15, a distance of
70.00 feet to the Northeast corner of said,r
No. 15;
THENCE South 12 025' 24 . 19" East along the East
line of said Lot No. 15, a distance of 140 .00
feet to the Southeast corner of said Lot No. 15;
