HomeMy WebLinkAboutRES 83-041 R E S O L U T I O N WHEREAS, an agreement has been negotiated for the purchase of a 20-foot wide utility easement needed for the Lawrence Drive Force Main, Contract 9A of EPA Grant #C-481254 ; NOW , THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the purchase from Lois McNeill, William Alan McNeill, Frances Anne McNeill, and Nina McNeill Christian of a 20-foot wide utility easement described in Exhibit "A" , attached hereto and made a part hereof for all purposes, is hereby authorized for the sum of $1 ,986.64. Mayor • r July 27, 1982 Page 1 Utilities Easement To The City of Beaumont Easement No. 4 FIELDNOTE DESCRIPTION of a twenty foot (20' ) wide utilities easement out of the Thomas Spear Survey, Abstract No. 50, in Beaumont, Jefferson County, Texas. ALL THAT CERTAIN tract or parcel of land being out of that original 70 acres of land described in Deed from J.W. O'Neal and Wife, Leonora E., to W.T. McNeill as recorded in Volume 748, Page 433 of the Deed Records of Jefferson County, Texas, said herein described tract being more fully bounded and described as follows: BEGINNING at the southwest corner of the .herein described tract, said corner being in the west line of the Thomas Spear Survey, Abstract No. 50, in the east line of Lot 21 , Block 10 of Park North Addition, plat of which appears in Volume 12, Page 45 of the Map Records of Jefferson County, Texas, and being located South zero degrees forty-one minutes West (S 00° 41 ' W) a distance of sixteen and zero hundredths feet (16.001 ) from the northeast corner of said Lot 21 , Block 10 which is also the point of intersection of the south and east lines of an existing drainage easement; 'THENCE with the east line of Lot 21, Block 10, Park North Addition, the west line of the Thomas Spear Survey, the west line of. the aforesaid W.T. McNeill Tract, and the west line of the herein described tract, North zero degrees forty-one minutes East (N 00' 41 ' E) at sixteen and zero hundredths feet (16.001 ) pass the northeast corner of Lot 21 , Block 10 and continuing with the east line of an existing drainage easement along said course for a total distance of one thousand two hundred forty-five and seventeen hundredths feet (1245. 171 ), more or less, to the northwest corner of the herein described tract, said corner being the southwest corner of that certain 5.08 acre tract of land described in Deed from W.T. McNeill to Gulf States Utilities Company as recorded in Volume 988, Page 395 of the Deed Records of Jefferson County, .Texas; EXHIBIT "A" July 27, 1982 Page 2 - m Utilities Easement To The City of Beaumont Easement No. 4 THENCE with the southerly line of said G.S.U. 5.08 acre tract and the northerly line of the herein described tract, South sixty-nine degrees fifty-one minutes East (S 69' 51 ' E) for a distance of twenty-one and twenty-one hundredths feet (21.211 ) to the northeast corner of the herein described tract; THENCE with the east line of the herein described tract, South zero degrees forty-one minutes West (S 00' 41 'W) for a distance of one thousand two hundred thirty-eight and ten hundredths feet (1238.101 ) to the southeast corner of the herein described tract; THENCE with the south line of the herein described tract, North eighty-nine degrees nineteen minutes West (N 89' 19' W) for a distance of twenty and zero hundredths feet (20.001 ) to the PLACE OF BEGINNING. CONTAINING IN AREA 0.5701 acres of land, more or less (24,833 Square Feet) TEMPORARY CONSTRUCTION EASEMENT - TWENTY FOOT 20' To be conveyed in addition to the above described 0.5701 acre easement is a temporary construction easement twenty feet in width, adjacent, parallel and east of the 0.5701 acre tract.
