HomeMy WebLinkAboutRES 82-392 R E S O L U T I O N WHEREAS, the City Council of the City of Beaumont deems it necessary to locate, construct, maintain, straighten, widen and extend a drainage easement in the City of Beaumont, Jefferson County, Texas; and, WHEREAS, said City Council has found that a public necessity exists requiring the location, construction, maintenance, straightening, widening, and extension of said easement on the hereinafter described property; and, WHEREAS, the City Council deems it necessary to acquire the hereinafter described interests in and to the hereinafter described property for said location, construction, widening, straightening and extension of said street, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated in good faith with the owners of the hereinafter described land and has been unable to agree with such owners of such property as to the fair market value thereof and damages, if any, NOW, THEREFORE, BE IT RESOLVED BY THE CI'T'Y OF BEAUMONT: THAT Kenneth Wall, City Attorney, be and he is hereby authorized and directed to file or cause to be filed against all owners of the following parcel of land, and all claimants of any interest therein, proceedings in eminent domain to acquire a drainage easement for said purposes, in and to the said parcel of land described in Exhibit "A" attached hereto and made a part hereof, the parcel of land being situated in Beaumont, Jefferson County, Texas. Provided, however, that the owners of said land shall be permitted to use the areas covered by the foregoing drainage easement for any purposes that will not interfere therewith, and the City Attorney is authorized and directed to describe such purposes as are consistent with the use of said drainage easement. PARIGI, JR.) BEING a 0.010 acre tract of land in the C. Williams Survey, Abstract No . 59 in Beaumont, Jefferson County, Texas and being out of that certain tract of land described in deed from Anthony C. Parigi , Jr . to Sam C. Parigi , Jr , dated December 28, 1979 and recorded in Vol . 2203 Page 8 of the Deed Records of Jefferson County, Texas and said 0.010 acre tract of land being more particularly described by metes and bounds as follows : FOR locative corner begin at a 3/4 inch iron pipe found at the intersection of the East right-of-way line of Shakespeare Drive (60 foot right-of-way) and the South line of that certain 50 foot railroad right-of-way described in deed from the Missouri Pacific Railroad Company to the City of Beaumont dated December 31, 1960 and recorded under the County Clerks File No . 59774 in the Deed Records of Jefferson County, Texas and locating the Northwest corner of said Sam C. Parigi , Jr . tract of land and the Northwest corner of that certain 20 foot wide strip of land described in deed from Anthony C. Parigi , Jr . to the City of Beaumont dated August 31, 1973 and recorded in Vol . 1801 Page 453 of the Deed Records of Jefferson County, Texas; THENCE South 0 degrees 31 minutes 55 seconds East along the East right-of-way line of said Shakespeare Drive a distance of 25.08 feet to a 5/8 inch iron rod placed in the proposed South right-of-way line of Phelan Boulevard (105 foot right-of-way) and the beginning of a nontangent curve concave to the North having a central -angle of 2 degrees 00 minutes 51 seconds, having a radius of 5779.6 feet and whose chord bears North 83 degrees 50 minutes 04 seconds East; THENCE in an Easterly direction along the proposed South right-of-way line of said Phelan Boulevard and the arc of said curve, an arc distance of 203.16 feet to the most Westerly corner of the tract of land herein described and locating the beginning of a curve concave to the North having a central angle of 0 degrees 52 minutes 49 seconds, having a radius of 5779.6 feet and whose chord bears North 82 degrees 23 minutes 14 seconds East; THENCE in an Easterly direction along the proposed South right-of-way line of said Phelan Boulevard and along said curve an arc distance of 88.79 feet to a 5/8 inch iron rod placed in the West line of an 80 foot wide drainage easement and to the West line of a 40 foot wide tract of land described in deed from. Fred C.
