HomeMy WebLinkAboutRES 82-355 R E S O L U T I O N WHEREAS, the City Council of the City of Beaumont deems it necessary that Phelan Boulevard in the City of Beaumont, Jefferson County, Texas be located, constructed, widened, extended and maintained; and, WHEREAS, said City Council has found that a public necessity exists requiring the location, construction, widening, extension and maintenance, of said street on the hereinafter described property; and, WHEREAS, the City Council deems it necessary to acquire the hereinafter described interests in and to the hereinafter described property for said location, construction, widening, extension and maintenance of said street, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated in good faith with the owners of the hereinafter described land and has been unable to agree with such owners of such property as to the fair market value thereof and damages, if any, NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF BEAUMONT: THAT Kenneth Wall, City Attorney, be and he is hereby authorized and directed to file or cause to be filed against all owners of the following parcel of land, and all claimants of any interest therein, proceedings in eminent domain to acquire fee title for said purposes, in and to the said parcel of land described in Exhibit "A" attached hereto and made a part hereof, the parcel of land being situated in Beaumont, Jefferson County, Texas: on A _/„i� KOHLERANDKOHLER July 20, 1982 FIELD NOTE DESCRIPTION OF THAT PORTION OF THE PHELAN BOULEVARD TRACT NO. 30 WITHIN THE 50 FOOT RAILROAD RIGHT-OF-WAY (LON WATERS ESTATE) BEING a 0.064 acre tract of land in the C. Williams Survey, Abstract No. 59 in Beaumont, Jefferson County, Texas and being out of that certain 50 foot railroad right-of-way conveyed by the Missouri Pacific Railroad to the City of Beaumont by deed dated December 31, 1960 and recorded under the County Clerk' s File No . 597774 in the Deed Records of Jefferson County, Texas and said 0.064 acre tract of land being more particularly described by metes and bounds as follows : BEGINNING at the Southwest corner of that certain tract of land described in deed from Sarah A. Collier to Lon Waters dated June 24, 1907 and recorded in Vol . 108 Page 394 of the Deed Records of Jefferson County, Texas and said corner lies in the North right-of-way line of said 50 foot railroad right-of-way and locates the Northwest and beginning corner of the tract of land herein described and also locates the beginning of a curve concave to the North having a radius of 5704.6 feet, having a central angle of 1 degree 07 minutes 18 seconds and whose chords bears North 75 degrees 54 minutes 35 seconds East; THENCE in an Easterly direction along the North line of said 50 foot railroad right-of-way and the arc of said curve an arc distance of 111.69 feet to the Southwest corner of the tract of land described in deed from Lon Waters to Clinton Waters dated September 14, 1950 and recorded in Vol . 809 Page 215 of the Deed Records of Jefferson County, Texas; THENCE South 14 degrees 39 minutes 04 seconds East a distance of 25.00 feet to the centerline of said 50 foot railroad right-of-way and the beginning of a nontangent curve concave to the North having a radius of 5729.6 feet, having a central angle of I degree 07 minutes 18 seconds and whose chord bears South 75 degrees 54 minutes 35 seconds West; THENCE in a Westerly direction along the centerline of said 50 foot railroad right-of-way and along the arc of said curve an arc distance of 112.18 feet to the Southwest corner of the tract of land herein described; THENCE North 13 degrees 31 minutes 45 seconds West a distance of 25.00 feet to the place of beginning and containing 0.064 acres of land.
