HomeMy WebLinkAboutRES 82-321 R E S 0 L U 11 1 0 N WHEREAS, the City Council of the City of Beaumont deems it necessary that Dowlen Road North in the City of Beaumont., Jefferson County, Texas be located, constructed, widened, extended and maintained; and, WHEREAS,, said City Council has found that a public necessity exists requiring the location, construction, widening, extension and maintenance, of said street on the hereinafter described property; and., WHEREAS, the City Council deems it necessary to acquire the hereinafter described interests in and to the hereinafter described property for said location, construction, widening, extension and maintenance of said street, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and., WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated in good faith with the owners of the hereinafter described land and has been unable to agree with such owners of such property as to the fair market value thereof and damages, if any , NOW., THEREFORE, BE IT' RESOLVED BY THE CITY OF BEAUMORT: THAT Kenneth Wall, City Attorney , be and he is hereby authorized and directed to file or cause to be filed against all owners of the following parcel of land, and all claimants of any interest therein, proceedings in eminent domain to acquire fee title for said purposes, in and to the said parcel of land described in Exhibit "All attached hereto and made a part hereof., the parcel of land being situated in Beaumont, Jefferson County , Texas : PASSED BY THE CITY COUNCIL of the City of Beaumont this the day of 19 mot . 4 ® Mayo r 2 - BEING a 0. 828 acre tract of land of and a part of that certain 4 . 06 acre tract as conveyed to Claude L. ,Worthy, et ux by deed dated 21 March 1975 by Helen Grace Tarter et vir and recorded in Volume 1872 , Page 310 of the Deed Records of Jeff- erson County, Te,EE- and more particularly described as follows: BEGINNING at a 1/2 inch iron pipe in the northerly right of way line of Comstock Road, said rod being the southwest corn- er of the tract herein described and also being the southeast corner of a tract of land conveyed by Jim Whitmeyer, Independent Executor of the Estate of L. J. Whitmeyer to Jimmy D. Miller, et ux by deed dated 4 May 1976 and recorded in Volume 1933 and Page 393 of the Deed Records of Jefferson County, Texas; THENCE South 84 degrees - 0 minutes East, 100. 68 feet with the northerly right of way line of Comstock Road to a 1/2 inch iron rod for a corner, said corner being the southeast corner of the tract herein described; THENCE North 0 degrees - 41 minutes West, 359. 07 feet along the east line of the tract herein described to an iron pin for a corner in the north property line of the 4 . 06 acre tract conveyed to Claude L. Worthy, et ux by deed dated 21 March 1975 by Helen Grace Tarter, et vir and recorded in Volume 1872 , Page 310 of the Deed Records of Jefferson County, Texas also being the south property line of a tract of land conveyed to George E. Murphy, et ux by deed dated 8 April 1974 by James H. Eaves, et ux and recorded in Volume 1826 , Page 70 of the Deed Records of Jefferson County, Texas, said point being the northeast corner of the tract herein described; THENCE North 82 degrees - 11 minutes West, 101. 11 feet along the north line of the said Worthy tract, also being the south property line of the said Murphy tract of land) to a 1/2 inch iron pin for a cornerr Said corner being the northwest corn- er of the tract herein described and also being the northwest corner of the said Worthy tract; THENCE South 0 degrees - 41 minutes East, 362 . 3 feet passing an iron pipe at 28 . 33 feet, said iron pipe being in the east line and also being a southeast corner of the said Murphy tract, also being the northwest corner of the said Miller tract, continuing 333 . 93 feet along the `,17est property line of the said Worthy tract;also being the east property line of the said Miller tract; TO THE POINT OF BEGINNING and containing 0. 828 acre of land more or less. 4,? -cR.0
