HomeMy WebLinkAboutRES 82-211 R E S 0 L U T 1 0 N BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby, authorized to enter into a lease agreement with the United States of America in the form shown in Exhibit "All attached hereto and made a part hereof for all purposes. PASSED BY THE CITY COUNCIL of the City of Beaumont this the day of 19 Mayor STATE OF TEXAS LAND LEASE COUNTY OF JEFFERSON 1. THIS LEASE, made and entered into this day of , 19 , by and between the City of Beaumont, Jefferson County, Texas, a political subdivision of the State of Texas whose address is City Hall, Beaumont, Texas, and whose interest in the property hereinafter described is that of owner for itself, its successors, and assigns, hereinafter called LESSOR, and The United States of America, hereinafter called the GOVERNMENT: WITNESSETH: The parties hereto for the considerations hereinafter mentioned covenant and agree as follows: 2 . The Lessor hereby leases to the Government the following described premises, viz: Beginning at a concrete monument in the intersection of the northerly line of the Gulf and Interstate Railroad right-of-way and the west line of Fourth Street right-of- way; said point being the northeast corner of tract herein described . Thence south 42 degrees - 25 minutes west along said northerly line of the Gulf and Interstate to railroad right-of-way, a distance of 550.1 feet to a concrete monument for a corner. Thence south 89 degrees - 59 minutes west along the north right-of-way line of College Street, a distance of 280 .37 feet, to a concrete monument for a corner. Thence north 00 degrees - 02 minutes, a distance of 406.25 feet to the northwest corner of the tract herein described . Thence north 89 degrees - 59 minutes east, a distance of 351.2 feet to a concrete monument for a corner. Thence south 89 degrees - 58 minutes east, a distance of 300 feet to the point of beginning and containing 4 .34 acres of land, more or less. to be used for the following purpose: Armed Service Center. 3 . TO HAVE AND TO HOLD the said premises for a term of ten ( 10) years commencing the day of , 1981 and ending the day of , 1991 . EXHIBIT "A" 4 . The Government shall pay the Lessor rent at the following rate: One dollar ($1 .00) per annum. 5 . The Government shall have the right, during the existence of this lease to attach fixtures, and erect structures, or signs, in or upon the premises hereby leased, which fixtures and structures, or signs, so placed in, upon or attached to the said premises shall be and remain the property of the Government and may be removed or otherwise disposed of by the Government. 6 . Any notice under the terms of this lease shall be in writing signed by a duly authorized representative of the party giving such notice, and if given by the Government shall be addressed to the Lessor at City Hall, Beaumont, Texas, and if given by the Lessor shall be addressed to 7 . No member of or delegate to Congress or resident commissioner shall be admitted to any share or part of this lease or to any benefit that may arise therefrom, but this provision shall not be construed to extend to this lease if made with a corporation for its general benefit.
