HomeMy WebLinkAboutRES 81-457 Fl� 4L S 7 R E S O L U T I O N WHEREAS, Haywood Walker, C. A. Kohler and M. L. Lefler, Jr . , as the joint owners of property, desire to donate to the City of Beaumont 10 .3 acres for a park; 2 .68 acres for the future extension of Rose Lane; 3.33 acres for the future extension of Dowlen Road and a 30 foot drainage easement, all as shown on Exhibit "A" attached hereto and made a part hereof; and, WHEREAS, M. L. Lefler, Jr. , as the individual owner, is conveying to the City another 1 .22 acres for Dowlen Road immediately south of the strip being donated by the three joint owners; and, WHEREAS, the City Council has considered the purpose of said proposed dedication and is of the opinion that the acceptance of said property is necessary and desirable and that same should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT said property as shown on Exhibit "A" and conveyed by the above named to the City of Beaumont be, and the same is hereby, in all things accepted . PASSED BY THE CITY COUNCIL of the City of Beaumont this the /Q;ZZ day of op 1991/ Mayor - EXHIBIT "A" TRACT NO. 1: STREET EASEMENT BEING a 3.33 acre tract of land out of the Thomas Spear Survey, Abstract No. 50 in Beaumont, Jefferson County, Texas and out of Tract No .2 as described in deed from Lindsey Walker to M. L. Lefler, Jr ., et al dated June 28, 1977 and recorded in Vol . 2011 Page 79 of the Deed Records of Jefferson County, Texas and said 110 foot wide right-of-way being more particularly described by metes and bounds as follows: FOR locative corner begin at the Southeast corner of said Tract No. 2 and the Northeast corner of that certain tract of land described in deed from Paul G. Rouse to M. L. Lefler, Jr dated March 8, 1961 and recorded in Vol . 1252 Page 76 of the Deed Recrods of Jefferson County, Texas; THENCE South 89 degrees 51 minutes 46 seconds West along said common line a distance of 405.2 feet to the Southeast and beginning corner of the tract of land herein described; THENCE continuing South 89 degrees 51 minutes 46 seconds West along said common line a distance of 110 feet to the Southwest corner of the tract of land herein described; THENCE North 108.52 feet to the beginning of a tangent curve concave to the Southwest having a radius of 1004.22 feet and a central angle of 25 degrees and 32 minutes; THENCE in a Northwesterly direction along the arc of said curve an arc distance of 447.52 feet to an iron stake; THENCE North 25 degrees 32 minutes West a distance of 157.46 feet to the beginning of a tangent curve concave to the Northeast having a radius of 1114.22 feet and having a central angle of 25 degrees 32 minutes; THENCE in a Northwesterly direction along the arc of said curve an arc distance of 496.54 feet to an iron stake for corner; THENCE North a distance of 110.32 feet to the North line of said Tract No.2 and the South line of Block D of the Meetzen Brothers Subdivision; according to the plat thereof recorded in Vol . 3 Page 229 of the Map Records of Jefferson County, Texas; THENCE South 89 degrees 40 minutes 06 seconds East along said common line a distance of 110 feet to an iron stake for corner; from which a 1 inch galvanized iron pipe at the Northeast corner of said Tract No. 2 bears South 89 degrees 40 minutes 06 seconds East a distance of 679.61 feet; THENCE South 109.68 feet to the beginning of a tangent curve concave to the Northeast having a radius of 1004.22 feet and having a central angle of 25 degrees 32 minutes; THENCE in a Southeasterly direction along the arc of said curve an arc distance of 447.52 feet to an iron stake; THENCE South 25 degrees 32 minutes East a distance of 157.46 feet to the beginning of a tangent curve concave to the Southwest having a radius of 1114.22 feet and having a central angle of 25 degrees 32 minutes; THENCE in a Southeasterly direction along the arc of said curve an arc distance of 496.54 feet to an iron stake; THENCE South 108.26 feet to the place of beginning containing 3.33 acres of land. EXHIBIT "A" TRACT NO. 2: STREET EASEMENT BEING a 60 foot right-of-way out of the Thomas Spear Survey, Abstract No. 50 in Beaumont, Jefferson County, Texas and being out of Tract No. 2 described in deed from Lindsey Walker to M. L. Lefler, Jr ., et al dated June 28, 1977 and recorded in Vol . 2011 Page 79 of the Deed Records of Jefferson County, Texas and said 60 foot right-of-way, the centerline of which, is described as follows : FOR locative corner begin at the Southeast corner of said Tract No . 2 and the Northeast corner of that tract of land described in deed from Paul G. Rouse to M. L. Lefler, Jr . dated March 8, 1961 and recorded in Vol . 1252 Page 76 of the Deed Records of Jefferson County, Texas; THENCE North 0 degrees 01 minutes West along the West right-of-way line of Comstock Road a distance of 1043.24 feet to the beginning of the proposed centerline of Rose Lane; THENCE North 89 degrees 40 minutes 06 seconds West parallel with and 225 feet South of the North line of said Tract No . 2 a distance of 175 feet to the beginning of a tangent curve concave to the Southeast having a radius of 313.99 feet and having a central angle of 35 degrees 19 minutes 54 seconds; THENCE in a Southwesterly direction along the arc of said curve an arc distance of 193.62 feet; THENCE South 55 degrees 00 minutes West a distance of 105.0 feet to the beginning of a tangent curve concave to the Northwest having a radius of 334.56 feet and having a central angle of 17 degrees 00 minutes; THENCE in a Southwesterly direction along the arc of said curve an arc distance of 99.27 feet; THENCE South 72 degrees 00 minutes West and at a distance of 158.79 feet pass the centerline of proposed Dowlen Road (110 foot right-of-way) and continue a total distance of 414.47 feet to the beginning of a tangent curve concave to the Northwest having a radius of 619.76 feet and having a central angle of 18 degrees 19 minutes 54 seconds; THENCE in a Westerly direction along the arc of said curve an arc distance of 198.29 feet; North 89 degrees 40 minutes 06 seconds West parallel with and 550 feet South of the North line of said Tract No. 2 a distance of 201.51 feet to the beginning of a tangent curve concave to the Northeast having a radius of 300.81 feet and having a central angle of 28 degrees 00 minutes; THENCE in a Northwesterly direction along the arc of said curve an arc distance of 147.0 feet; THENCE North 61 degrees 40 minutes 06 seconds West a distance of 56.34 feet to the beginning of a tangent curve concave to the Southwest having a radius of 300.81 feet and having a, central angle of 28 degrees 00 minutes; THENCE in a Northwesterly direction along the arc of said curve an arc distance of 147.0 feet; THENCE North 89 degrees 40 minutes 06 seconds West parallel with and 453.13 feet South of the North line of said Tract No. 2 a distance of 318.7 feet to an iron stake in the West line of said Tract No. 2 and the East line of Woodland Acres Addition, according to the plat thereof recorded in Vol . 10 Page 46 of the Map Records of Jefferson County, Texas; from said iron stake an iron rod found in the South line of the existing Rose Lane (60 foot right-of-way) bears South 0 degrees 37 minutes 28 seconds West a distance of 30 feet; The above described 60 foot right-of-way for proposed Rose Lane contains 2.83 acres of land of which 0.15 acres lies in the proposed Dowlen Road right-of-way. EXHIBIT "A" TRACT NO. 3: PARK SITE BEING a 10.01 acre tract of land out of the Thomas Spear Survey, Abstract No . 50 in Beaumont, Jefferson County, Texas and being out of Tract No. 2 as described in deed from Lindsey Walker to M. L. Lefler, Jr ., et al dated June 28, 1977 and recorded in Vol . 2011 Page 79 of the Deed Records of Jefferson County, Texas and said 10.01 acre tract of land being more particularly described by metes and bounds as follows: FOR locative corner begin at an iron rod found in the South line of Rose Lane (60 foot right-of-way) at the Northeast corner of Lot 1 Block 8 of Woodland Acres Addition, according to the plat thereof recorded in Vol . 10 Page 46 of the Map Records of Jefferson County, Texas and said iron rod lies in the West line of said Tract No. 2; THENCE North 0 degrees 37 minutes 28 seconds East along the West line of said Tract No . 2 a distance of 5 feet to the South line of proposed Rose Lane (50 foot right-of-way) ; THENCE South 89 degrees 40 minutes 06 seconds East along the South right-of-way line of proposed Rose Lane a distance of 318.83 feet to the Northwest and beginning corner of the tract of land herin described and the beginning of a tangent curve concave to the Southwest having a radius of 275.81 feet and having a central angle of 28 degrees 00 minutes; THENCE in a Southeasterly direction along the South right-of-way line of proposed Rose Lane and the arc of said curve an arc distance of 134.79 feet; THENCE South 61 degrees 40 minutes 06 seconds East along the South right-of-way line of proposed Rose Lane a distance of 56.34 feet to the beginning of a tangent curve concave to the Northeast having a radius of 325.81 feet and having a central angle of 28 degrees 00 minutes; THENCE in a Easterly direction along the South right-of-way line of proposed Rose Lane and the arc of said curve an arc distance of 159.22 feet; THENCE South 89 degrees 40 minutes 06 seconds East along the South right-of-way line of proposed Rose Lane parallel with and 575 feet South of the North line of said Tract No. 2 a distance of 201.51 feet to the beginning of a tangent curve concave to the Northwest having a radius of 644.76 feet and having a central angle of 7 degrees 22 minutes 58 seconds; THENCE in a Easterly direction along the South line of proposed Rose Lane and the arc of said curve an arc distance of 83.08 feet; THENCE South 0 degrees 19 minutes 54 seconds West a distance of 672.40 feet to the North line of a 50 foot drainage easement described in deed from M. W. White to Berdie Richardson dated November 7, 1929 and recorded in Vol . 356 Page 600 of the Deed Records of Jefferson County, Texas; THENCE North 0 degrees 05 minutes 50 seconds East along the East line of said Richardson tract a distance of 330.58 feet to the Northeast corner of said Richardson tract; THENCE North 0 degrees 19 minutes 54 seconds East a distance of 458.30 feet to the place of beginning containing 10.01 acres of land . EXHIBIT "A" TRACT NO. 4: DRAINAGE EASEMENT BEING a 0.81 acre tract of land out of the Thomas Spear Survey in Beaumont, Jefferson County, Texas and being out of that tract of land described as Tract No . 2 in deed from Lindsey Walker to M. L. Lefler, Jr . , et al dated June 28, 1977 and recorded in Vol . 2011 Page 79 of the Deed Records of Jefferson County, Texas and said 0.81 acre tract of land being more particularly described by metes and bounds as follows : BEGINNING at a 2 inch drill stem in the North line of said Tract No. 2 locating the Northwest corner of said Tract No . 2 and the Southwest corner of that certain tract of land conveyed by Oscar K. Wu, et al to William P . Terrell , et al by deed dated March 1, 1976 and recorded in Vol . 1923 Page 153 of the Deed Records of Jefferson County, Texas and lying in the East line of Woodland Acres Addition, as said subdivision is recorded in Vol . 10 Page 46 of the Map Records of Jefferson County, Texas and locating the Northwest and the beginning corner of the tract of land herein described; THENCE South 89 degrees 40 minutes 06 seconds East with the North line of said Tract No. 2 and the South line of said Terrell tract a distance of 1174.57 feet to a point for corner in the West line of the proposed 110 foot wide right-of-way for Dowlen Road; THENCE South with said line a distance of 30.0 feet to a point for corner; THENCE North 89 degrees 40 minutes 06 seconds West a distance of 1175.73 feet to a point for corner in the West line of said Tract No . 2 and in the East line of said Woodland Acres Addition; THENCE North 02 degrees 12 minutes 15 seconds East with said line a distance of 30.02 feet to the place of beginning containing 0.81 acres of land.
