WHEREAS, there is now pending in the District Court of
Jefferson County , Texas, a case entitled Michael Phelan, et al vs .
the City of Beaumont, No . B-105 ,700 ; and,
WHEREAS, the parties have agreed to settle and compromise
the case;
NOW , THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Attorney be, and he is hereby , authorized to agree to
entry of a judgment in the above styled cause in substantially the
form attached hereto as Exhibit "A" .

FINAL JUDGMENT
BE IT REMEMBERED that on this, the day of ,
1981 , there came on to be heard and considered the captioned cause and
there came the parties, plaintiff and defendant in person and by and
through their attorney of record and all parties being before the
court and having announced ready for trial , the jury was waived and
the parties announced in open court that all facts and matters herein
had been settled and compromised. Having inquired into said
settlement and determining same to be in all respects fair and just ,
it is accordingly the judgment of the court and it is ORDERED,
ADJUDGED, and DECREED:
I.
That with respect to the assessments of property tax made by
the City of Beaumont, Texas upon the properties described on the
attached Exhibit A which is incorporated herein by reference for all
purposes as fully as if set out in hac verba, the court finds that the
assessments heretofore made by the City of Beaumont, Texas, its Tax
Assessor and Board of Equalization for the years 1976 , 1977 , 1978 ,
1979 , 1980 and 1981 are hereby erroneous and are set aside and held
for naught.
II.
It is further ORDERED, ADJUDGED, and DECREED that the
following one hundred percent of fair market values with respect to
each of the respective tracts of land in question are:
Account No . 77-435-00 (S. Stivers) - $1 ,205,000.00
Account No . 61-035-00 (Spotts & Campbell - 128 ,000.00
L1 thru L32)
Account No . 63-316-00 (Tyrrell W. C. Subd. - 1281000.00
L1 thru L16)
Account No . 77-392-00 (C . Williams) - 154,000.00
III.
It is further ORDERED, ADJUDGED, and DECREED, that no
penalty shall be assessed against plaintiffs for the failure to pay
taxes to the defendant for the years 1976 , 1977 , 1978 , 1979 and 1980
upon said tracts if said taxes are paid within thirty ( 30) days of the
date of this judgement. Provided, however, that plaintiffs shall pay
to defendant taxes in full based upon the appropriate rate and ratio
of assessment on the fair market values determined herein together
with interest at the rate established by law for delinquent taxes
from February 1 of each year, 1977 , 1978 , 1979 , and 1980 and
defendants' assessor and collector of taxes shall issue a full receipt
for said payments.
