HomeMy WebLinkAboutRES 81-210 R E S O L U T I O N WHEREAS, the City Council of the City of Beaumont deems it necessary to locate, construct, maintain, straighten, widen and extend an underground utility easement in the City of Beaumont, Jefferson County, Texas; and, WHEREAS, said City Council has found that a public necessity exists requiring the location, construction, maintenance, straightening, widening, and extention of said easement on the hereinafter described property; and, WHEREAS, the City Council deems it necessary to acquire the hereinafter described interest in and to the hereinafter described property for said location, construction, maintenance, straightening, widening, and extention of said easement, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated in good faith with the owner of the hereinafter described land and has been unable to agree with such owner of such property as to the fair cash value and damages, if any, thereof: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Attorney be, and he is hereby, authorized and directed to file or cause to be filed against the owner of the herein described property, and all claimants of interest therein, proceedings in eminent domain to acquire an easement for said purposes, in and to the parcel of land described in Exhibit "A1l attached hereto and made a part hereof, said parcel of land situated in Beaumont, Jefferson County, Texas. �/o?/U /Z-?,) Ai ,IIIS//o0//7 9 Provided, however, that the owners of said land shall be permitted to use the areas covered by the foregoing easement for any purposes that will not interfere therewith, and the City Attorney is authorized and directed to describe such purposes as are consistent with the use of said easement. PASSED BY THE CITY COUNCIL of the City of Beaumont this they day of ► 19 Mayor - 2 - Water and Sewer Easement Suggested Description "Being a 6 , 267 . 5 square foot parcel of land situated in the David Brown League and being out of a tract of land described in Volume 1747 , Page 161, and more fully described and referred to as Tract 2 in a deed recorded in Volume 428 , Page 635 of the Deed Records of Jefferson County, Texas, said parcel being more particularly described by metes and bounds as follows, to wit: For a locative point, the intersection of the East line of Wallace Street and the North line of Buford Street described in Volume 428 , Page 635; THENCE South 89°14 ' East, 436. 65 feet to a point; THENCE North 12 030 ' West, 63 . 27 feet to the PLACE OF BEGINNING of the herein described easement; THENCE North 00°30 ' East, 70. 00 feet along the approximate center of a draw as described in the aforementioned deed reference, (said draw since replaces. with a sixty (60") inch concrete storm sewer pipe) , to an angle point; THENCE North 06 030 ' East, 70. 00 feet along said draw to an angle point; THENCE North 12 030 ' East, 80. 00 feet along said draw to an angle point; THENCE North 14 015 ' East, 40 . 00 feet along said draw to an angle point; THENCE North 02 020 ' East, 51 . 64 feet along said draw to a point for corner; TfiENCE South 89 023 ' Vest, 20 . 07 feet along the North line of the herein described tract to a point for corner, being in the North line of the tract in the aforementioned deed reference; THENCE South 02 020 ' West, 48 . 52 feet along the West line of the herein described twenty (20 ' ) foot wide easement to an angle point; THENCE South 14 115 ' West, 36 . 64 feet to an angle point; THENCE South 12°30 ' West, 81. 36 feet to an angle point; THENCE South 06°30 ' West, 73. 68 feet to an angle point; THENCE South 00°30 ' West, 74 . 91 feet to a point for corner in the Southernmost point of the herein described easement; THENCE North 79 134 ' East, 20. 37 feet to the PLACE OF BEGINNING of the herein described tract.
