ENTITLED AN ORDINANCE CONCERNING THE
STRUCTURE LOCATED AT 3700 HIGHLAND; PROVIDING
FOR SEVERABILITY AND PROVIDING FOR A PENALTY.
WHEREAS, the structure located at 3700 Highland (Old Lamar Theater) has
previously been declared a dangerous structure; and
WHEREAS, City Council ordered the property owner to initiate a Work Repair
Program for roof repairs; and
WHEREAS, the Building Codes Department issued a permit to the property owner
for roof repairs valued at $300.00; and
WHEREAS, a physical inspection of the structure by the Building Codes
Department revealed that the roof requires replacement at a cost exceeding 50% of the
appraised value of the structure in order to comply with City codes; and
WHEREAS, the property owner has failed to comply with previous orders; and,
WHEREAS, the property owner appeared at the public hearing October 20, 1998;
NOW, THEREFORE, BE IT ORDAINED
BY THE CITY OF BEAUMONT:
Section 1.
In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont,
Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103.4
of the Standard Building Code, it is hereby ordered that the owner of the building at 3700
Highland (Old Lamar Theater) enter into a work program on or before November 3, 1998
and replace the roof on the structure on or before January 1, 1999. Staff shall inspect the
work every 30 days after commencement to assure that progress is made in accordance
with the work program.
Section 2.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 3.
That any person who violated any provision of this ordinance shall, upon conviction,
be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
