HomeMy WebLinkAboutORD 98-65 ORDINANCE NO. �� ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR DEMOLITION, RENOVATION AND REMOVAL; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont has heretofore found and declared the buildings located at: 1. 3990 Anita 25. 3346 West Lane&Garage 3. 2535 Brickyard Road 26. 790 Avenue D 4. 11725 Carpenter Road 27. 3750 Brandon 5. 1465 College 29. 806 College (Commercial) 6. 2811 Crockett 30. 1941 College (Front Commercial structure) 7. 1160 Delaware 31. 4365 Ector 8. 2960 Elinor 32. 3950 Estelle 9. 1305 Euclid 33. 4270 S. 5th 10. 1635 Gilbert 34. 2425 Harriot 12. 1192 Gulf 35. 695 Highland Drive 13. 8090 Helbig Road 36. 1830 Highland 14. 805 Lincoln 38. 4955 Mallett(Garage Apartment) 15. 1055 Lincoln 39. 1010 Orange 16. 2355 Pecan 41. 1010 Pipkin 17. 1696-98 Port(Duplex) 42. 3162 Prairie 18. 4235 Pradice 45. 3020 W. Crockett 19. 5190-92 Roberts Road 46. 1745 Levy 21. 550 Schwarner 48. 999 Orange 22. 955 Stanton 49. 3075 Roberts 23. 2645 Washington Blvd. 50. 2685 Santa Fe 24. 3315 Waverly to be public nuisances in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property, and has ordered them to be repaired or demolished. Section 2. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within thirty (30) days of the effective date of this ordinance: 1. 3990 Anita 17. 1696-98 Port(Duplex) 3. 2535 Brickyard Road 18. 4235 Pradice 4. 11725 Carpenter Road 19. 5190-92 Roberts Road 5. 1465 College 21. 550 Schwarner 6. 2811 Crockett 22. 955 Stanton 7. 1160 Delaware 23. 2645 Washington Blvd. 8. 2960 Elinor 24. 3315 Waverly 9. 1305 Euclid 25. 3346 West Lane&Garage 10. 1635 Gilbert 45. 3020 W. Crockett 12. 1192 Gulf 46. 1745 Levy 13. 8090 Helbig Road 48. 999 Orange 14. 805 Lincoln 49. 3075 Roberts 15. 1055 Lincoln 50. 2685 Santa Fe 16. 2355 Pecan - 2 - If the property is not demolished as set out above, the City is authorized to demolish the structure and assess the cost as a special tax. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings either demolish or repair said structures within thirty (30) days of the effective date of this ordinance: 26. 790 Avenue D 34. 2425 Harriot 27. 3750 Brandon 35. 695 Highland Drive 29. 806 College (Commercial) 36. 1830 Highland 30. 1941 College (Front Commercial structure) 38. 4955 Mallett(Garage Apartment) 31. 4365 Ector 39. 1010 Orange 32. 3950 Estelle 41. 1010 Pipkin 33. 4270 S. 5th 42. 3162 Prairie Section 4. The following structures are hereby ordered to be demolished and removed by the City of Beaumont on account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the buildings are situated. That the City Council, the City of Beaumont finds and declares that the buildings located at: 2. 4125 Bennet Road 59. 1910 Grand 11. 560 E.Gill 70. 2801 Pine (Rear) 20. 5225 Roberts Road 74. 570 E. Simmons 28. 4115 Brandon 79. 2480 Taylor 40. 1495 Pennsylvania (Commercial) are public nuisances in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or -4 - property. The owners or persons representing such owners appeared at the public. hearing October 20, 1998 and were notified and are hereby ordered as follows: The owners or persons representing owners shall enter into and execute a work program on or before November 3, 1998, the same being fourteen (14) days after the public hearing. By such date the building shall be secured from entry such that persons not authorized to be in the building cannot obtain access to the building. Rehabilitation of the structure as outlined in the work program shall commence within sixty (60) days after October 20, 1998 and such rehabilitation shall be completed within the 120-day period allowed by the work program. Inspectors are directed after a rehabilitation commences to inspect the structures to ensure that progress is continuing in accordance with the work program. If any of the above described conditions are not met, the structure shall once again be presented to Council with a request for a demolition order. Section 6. That the City Council of the City of Beaumont finds and declares that the buildings located at: 37. 3902 Higland (Commercial) 47. 4142 Ogden 43. 995 Avenue B 58. 2778 Goliad 44. 1490 Avenue F are public nuisances and that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or - 5 - property. The owners or persons representing such owners appeared at the Public Hearing October 20, 1998 and were notified and are hereby ordered as follows: The owners or persons representing the owners shall enter into and execute a work program on or before thirty (30) days after October 20, 1998. By such date, the building shall be secured from entry such that persons not authorized to be in the building cannot obtain access to the building. Structure shall be rehabilitated in accordance with the work program. Section 7. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance and, to such end, the various portions and provisions of this ordinance are declared to be severable. Section 8. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
