ENTITLED AN ORDINANCE AMENDING CHAPTER 2'/ OF
THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT
TO AMEND REGULATIONS AND FEES CONCERNING
BURGLARY ALARM SYSTEMS; PROVIDNG FOR
SEVERABILITY; PROVIDING FOR REPEAL.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
THAT Chapter 2'/, Section 2'/-11 be and the same and is hereby amended to
amend the definition of"false alarm" to read as follows:
False alarm means an alarm notification to the police
department when the responding officer or a subsequent
investigation finds no evidence of unauthorized intrusion or
attempted unauthorized intrusion, or other illegal activity for
which the alarm was intended to report.
Section 2'/-12 be and the same is hereby amended to read as follows:
The Police Department will not respond to a permitted alarm
site if such site has had more than eight (8) false burglary
alarm calls in any twelve-month period. In such case, a
certified letter will be mailed to the owner's address as
provided in the permit application and the owner will be
allowed five working days after receipt of the letter to reinstate
to a response status. A location may initially be reinstated to
a response status upon payment of a Fifty ($50.00) Dollar fee.
Each subsequent reinstatement thereafter will require payment
of a One-Hundred ($100.00) Dollar fee.
Section 2'/-13 (b) be and the same is hereby amended to read as follows:
2'/-13 (b). The application shall be submitted with a $15.00
fee to the City on a form provided by the City. Any false
statement made by an applicant on the application may be
prosecuted as a violation of Section 37.10 of the Texas Penal
Code, Tampering with Governmental Records, a third-degree
felony.
Section 2'/-13 (d) be and the same is hereby repealed and 2'/-13 (e) is hereby re-
lettered as "(d)".
Section 2'/2-14 (3) (4) and (5) be and the same are hereby repealed. Section 2'/-15
(3) be and the same is hereby repealed. Section 2'/-18 be and the same is hereby
repealed and the remainder of Chapter 2'/ is hereby renumbered to reflect such repeal.
Sections 2Y2-24, 21/2-25 and Subsection 2'/-26 (b) be and the same are hereby
repealed and Section 2'/-26 (c) be and the same is hereby re-lettered as "(b)".
Section 2.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 3.
All ordinances or parts of ordinances in conflict herewith are repealed to the extent
of the conflict only.
