ENTITLED AN ORDINANCE VACATING AND ABANDONING
SEVERAL DEDICATED UTILITY EASEMENTS IN THE
FERGUSON DEVELOPMENT PARK ADDITION IN THE
CHARLES WILLIAMS SURVEY, AB. #59, LOCATED
SOUTHEAST OF IH-10 S., NORTH OF WALDEN ROAD AND
WEST OF HILLEBRANDT BAYOU, CITY OF BEAUMONT,
JEFFERSON COUNTY, TEXAS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR REPEAL.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
THAT the following easements described below and shown on Exhibit "A' be and the same
are hereby abandoned:.
1. the 20' wide "electric" easement lying 10' along
either side of the common side lot line between
Tract II and Tract IV, as shown on the replat of
Tracts II and IV, Ferguson Development Park,
containing 0.146 acres, more or less;
2. the 20' wide "electric" easement lying along the rear
or west lot lines of Tracts I I and IV, as shown on the
replat of said two tracts, containing 0.519 acres,
more or less;
3. the 20' wide "electric and gas" easement lying 10'
along either side of the common side lot between
Tract IV and Tract VI, as shown on the Replat of
Tracts 11 and IV, said Ferguson Development Park
and as also shown on the original plat of Tracts I
through VII, said addition, containing 0.159 acres,
more or less;
4. the 20' wide "electric and gas" easement lying along
the west lot line of said Tract No. VI, as shown on
the original plat of Ferguson Park, containing 0.106
acres, more or less; and
5. the 20' wide "electric and gas" easement which
extends 422.28' along and across the south part of
Lot VI, said original plat, said easement situated
100' north of the south property line of Tract VI,
abutting a 100' wide drainage easement (DD #6)
which extends across the south 844.56' of the
addition, containing 0.194 acres, more or less. The
drainage easement is platted and dedicated in
Tracts VI and VII.
Section 2.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 3.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
