ENTITLED AN ORDINANCE AMENDING THAT CERTAIN
ORDINANCE AUTHORIZING THE ISSUANCE OF $3,100,000
THE CITY OF BEAUMONT, TEXAS, CONTRACTUAL
OBLIGATIONS, SERIES 1997; AND CONTAINING OTHER
MATTERS RELATED THERETO; PROVIDE FOR
SEVERABILITY.
WHEREAS, on August 5, 1997, the City of Beaumont, Texas (the "City") approved
and adopted that certain ordinance titled "ORDINANCE AUTHORIZING THE ISSUANCE
OF $3,100,000 THE CITY OF BEAUMONT, TEXAS, CONTRACTUAL OBLIGATIONS,
SERIES 1997; AND CONTAINING OTHER MATTERS RELATED THERETO: (the
"Ordinance"), pursuant to which the City authorized the issuance of its Contractual
Obligations, Series 1997, in the principal amount of $3,100,000 (the "Obligations"), and
WHEREAS, the Obligations are to be issued pursuant to the Ordinance to finance
the City's purchase and acquisition of certain personal property (the "Property") listed and
described in Exhibit "A" attached to the Ordinance; and
WHEREAS, the City desires to amend the Exhibit "A" attached to the Ordinance for
the purpose of substituting one of the items of Property listed in the Exhibit "A" with other
items of personal property; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS,
THAT:
1. Findings and Determinations. The City Council hereby finds and
determines that the facts and recitations contained in the preamble
of this Ordinance are true and correct.
2. Amendment. Exhibit "A" to the Ordinance is hereby amended and
restated in the form of the new Exhibit "A" attached hereto and
incorporated herein by reference, and the new Exhibit "A" shall be
attached to and made a part of the Ordinance in place of the original
Exhibit "A" attached thereto. Pursuant to such amendment, and in
accordance with the terms of the Ordinance, the Obligations shall be
issued to finance the City's acquisition and purchase of the personal
property listed in the new Exhibit "A" attached hereto.
