ENTITLED AN ORDINANCE AMENDING ORDINANCE NO. 97-7 WHICH CALLED THE GENERAL ELECTION IN THE CITY OF BEAUMONT FOR THE 3RD DAY OF MAY, 1997, BY PROVIDING A MAXIMUM OF FIVE (5) CLERKS AT EACH ELECTION PRECINCT AND PROVIDING THAT PRECINCT 86 WILL VOTE WITH PRECINCT 27 AT AMELIA ELEMENTARY SCHOOL; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. WHEREAS, on the 18th day of February, 1997, the City of Beaumont enacted Ordinance 97-7 calling a general election to be held in the City of Beaumont on the 3rd day of May, 1997; and WHEREAS, said ordinance provided that Precinct 86 would vote at the Oaks Educational Center which has burned and is no longer available as a polling place; and WHEREAS, Precinct 86 abuts Precinct 27 which votes at Amelia Elementary School and, because there is no other location within Precinct 86 available to serve as a polling place on the day of the election, Precinct 86 should vote at Amelia Elementary School with Precinct 27; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. THAT Ordinance 97-7 be and the same is hereby amended to amend Section 5 to read as follows: "Section 5. Said election shall be held in the City of Beaumont between the hours of 7:00 a.m. and 7:00 p.m. at the places listed in Exhibit 'W' attached hereto and made a part hereof for all purposes. The persons whose names appear in Exhibit "A" are appointed presiding judges and alternates for the respective polling places with authority to select and appoint clerks. "Pursuant to Sections 32.032 and 32.033 of the Texas Election Code, the presiding judge for each election precinct shall appoint a minimum of two (2) clerks and a maximum of five (5) clerks for the proper conduct of the election." Section 2. Exhibit "A" to the 1997 General Election Ordinance be and the same is hereby amended to show that Precinct 86 will vote with Precinct 27 at Amelia Elementary School, 565 South Major Drive, Beaumont, Texas, 77707, with Huberta Maynor as Election Judge and Jeanette Hoffpauir as Alternate Judge. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only.
