HomeMy WebLinkAboutORD 96-70 ORDINANCE NO. ;7C ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW AN EMPLOYEE PARKING LOT ON A 50' X 150' LOT IN AN AREA ZONED RCR (RESIDENTIAL CONSERVATION AND REVITALIZATION) DISTRICT FOR PROPERTY LOCATED AT 2315 MCFADDIN AVENUE IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, the City Council for the City of Beaumont desires to issue a specific use permit to Baker Auto Repair to allow an employee parking lot in an area zoned RCR (Residential Conservation and Revitalization) District on 0.172 acres of land, more or less, being Lot 4, Block 21, Averill Addition to the City of Beaumont, as shown on Exhibit "A" attached hereto, in Beaumont, Jefferson County, Texas, and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That all conditions necessary for issuance of a specific use permit have been met and a specific use permit to allow an employee parking lot in an area zoned RCR (Residential Conservation and Revitalization) District on 0.172 acres of land, more or less, being Lot 4, Block 21, Averill Addition to the City of Beaumont, as shown on Exhibit "A" attached hereto, in Beaumont, Jefferson County, Texas, is hereby granted to Baker Auto Repair, their legal representatives, successors and assigns for that certain tract shown on Repair, their legal representatives, successors and assigns for that certain tract shown on Exhibit"A" attached hereto and made a part hereof for all purposes subject to the following conditions: 1) Allow access to McFaddin with a wrought iron gate to be closed except during the following hours: 7:30 a.m. - 8:30 a.m., 11:30 a.m. - 1:30 p.m. and 5:30 p.. - 6:30 p.m. 2) The north end of the employee parking lot shall be landscaped with a minimum 6' wide landscape edge planted in accordance with Section 30-31 (c) (3) of the Zoning Ordinance; and 3) The parking lot must be set back 48' from the property line on McFaddin unless application is made to and a variance of the setback requirement from 48' to 25' is granted by the Zoning Board of Adjustment. Section 2. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit "B" and made a part hereof for all purposes. Section 3. Notwithstanding the site plan attached hereto, the use of the property hereinabove described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.
