HomeMy WebLinkAboutORD 96-44 ORDINANCE NO. � ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW A CHURCH SPONSORED HIGH SCHOOL WITHIN AN RS (RESIDENTIAL SINGLE FAMILY DWELLING) DISTRICT FOR PROPERTY LOCATED ON HIGHWAY 105, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, the City Council for the City of Beaumont desires to issue a specific use permit to Cathedral in the Pines Christian Center, Inc. to allow a church sponsored high school in an area zoned RS (Residential Single Family Dwelling) District on 43.5 acres, more or less, being tracts 1, 2, and 3, Tax Plat RS-5, D. Easley Survey, Abstract 20, as shown on Exhibit "A" attached hereto, in Beaumont, Jefferson County, Texas; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That all conditions necessary for issuance of a specific use permit have been met and a specific use permit to allow a church sponsored high school on property located on Highway 105 in an area zoned RS (Residential Single Family Dwelling) District on 43.5 acres, more or less, being tracts 1, 2 and 3, Tax Plat RS-5, D. Easley Survey, Abstract 20, as shown on Exhibit"A" attached hereto, in Beaumont, Jefferson County, Texas is hereby granted to Cathedral in the Pines Christian Center, Inc., its legal representatives, successors and assigns for that certain tract described on Exhibit "A" attached hereto and made a part hereof for all purposes, subject to the above and following conditions: 1. Two 36' driveways shall be constructed as part of Phase development for safety and traffic circulation; and, 2. A 30' landscape buffer shall be installed along the entire east property line of the subject property as part of Phase I. Section 2. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit "B" and made a part hereof for all purposes Section 3. Notwithstanding the site plan attached hereto, the use of the property hereinabove described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.
