HomeMy WebLinkAboutORD 96-22 ORDINANCE NO. �Z ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY ADDING LOT 321, BLOCK 50, BEAUMONT TOWNSITE SUBDIVISION TO THE CITY OF BEAUMONT AS AN HISTORIC-CULTURAL LANDMARK PRESERVATION DESIGNATION (HC-L); PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Section 1. BE IT ORDAINED BY THE CITY OF BEAUMONT: That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-5(b) thereof, is hereby amended by expanding the Historical-Cultural Landmark Preservation Designation (HC-L) to include all of Lot 321, Block 50, Beaumont Townsite Subdivision to the City of Beaumont as shown on Exhibit "A" attached hereto and made a part hereof for all purposes and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That, in all other respects, the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance and, to such end, the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5. That any person who violates any provision of this ordinance shall, upon conviction, be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. Existing or proposed recognition as a National Historic Landmark, or Texas Historic Landmark, or entry or proposed entry into the National Register of Historic Places; b. Existence of distinguishing characteristics of an architectural type or specimen, or of the social, economic, or political heritage of the City; ANALYSIS continued C. Identification as the work of a designer, architect, or builder whose work has influenced the growth or development of the City; d. Embodiment of elements of architectural design, detail, materials, or craftsmanship which represent a significant architectural innovation or an outstanding example of a particular historical, architectural or other cultural style or period; e. Relationship to other buildings, structures, or places which are eligible for preservation as historic places; L Exemplification of the cultural, economic, social, ethnic, or historical heritage of the City, County, State or Nation; g. Location as the site of a significant historical event; h. Listing in the S.P.A.R.E. Beaumont Survey; i. Identification with a person or persons who significantly contributed to the culture or development of the City, County, State or Nation; and j. A building, structure, or place that because of its location has become of historic or cultural value to a neighborhood or community. Staff is of the opinion that the building at 695 Park Street meets and complies with six of the ten listed criteria. b. The San Augustine building represents the type of commercial structure built on the edge of the Central Business District when Beaumont was expanding after the second Spindletop boom. d. The San Augustine building is an example of an early twentieth century commercial building. Major brick piers and original storefronts remain and will be restored by the applicant. e. This building is located on the edge of the downtown National Register District. The renovation of this building will have an overall positive effect on the vitality of the central business district. The more vital the downtown, the more likely other buildings actually in the National Register District will be saved. f. The name of the building represents the Spanish influence in Beaumont. h. The San Augustine Building is listed in S.P.A.R.E. Beaumont. ANALYSIS continued j. Due to the building's proximity to Beaumont's National Register District, its renovation will contribute to the past, present and future preservation efforts in downtown.
