ENTITLED AN ORDINANCE AMENDING ORDINANCE 95-24 WHICH ESTABLISHED THE DRUG FREE BEAUMONT COMMISSION TO CHANGE THE SIZE OF THE COMMISSION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. WHEREAS, on the 11th day of April, 1995, the City of Beaumont established the Drug Free Beaumont Commission charged with the task of fighting substance abuse in Beaumont; and, WHEREAS, it is desired to amend the size such commission; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. THAT Ordinance 95-24 be and the same is hereby amended to amend Section 1 of such ordinance to read as follows: Section 1. That there is hereby created the "Drug Free Beaumont Commission" composed of 21 members. Of the initial 21 members 15 shall be appointed by the Mayor from the membership of the Mayor's Coalition for a Drug Free Beaumont. The terms of 10 of such 15 members shall be for two (2) years and the terms of 5 of such 15 members shall be for three (3) years. The remaining 6 members of the initial 21 member board shall be appointed by the City Council of the City of Beaumont with each City Council member other than the Mayor appointing one (1) member to the Commission. The initial term of such six (6) members shall be three (3) years. Thereafter the term of office of each member shall be two (2) years or until a successor is appointed. A chairperson and vice-chairperson of the Commission shall be appointed by the Mayor. Vacancies resulting from resignations or other reasons during a term shall be filled by the City Council for the unexpired term. Vacancies resulting from expiration of a term shall be filled by each council member on a rotating basis. Members of the Drug Free Beaumont Commission shall serve without compensation and all members of such Commission shall be subject to removal at the will and pleasure of the City Council. Section 2. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 3. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. PASSED BY THE CITY COUNCIL on this the l.,M day ofd% , 1996. log - Mayor -
