HomeMy WebLinkAboutORD 96-05 t ORDINANCE NO. .� ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW THE CONSTRUCTION OF A CHURCH IN AN AREA ZONED RM-H (RESIDENTIAL MULTIPLE FAMILY DWELLING-HIGHEST DENSITY) DISTRICT FOR PROPERTY LOCATED AT 3175 S. MAJOR DRIVE, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, the City Council for the City of Beaumont desires to issue a specific use permit to Seventh-Day Adventist Church of Beaumont to allow the construction of a church in an area zoned RM-H (Residential Multiple Family Dwelling-Highest Density) District on a 3 acre tract of land located on the east side of Major Drive, as described on Exhibit "A" and as shown on Exhibit"B" attached hereto, in Beaumont, Jefferson County, Texas; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That all conditions necessary for issuance of a specific use permit have been met and a specific use permit to allow the construction of a church in an area zoned RM-H (Residential Multiple Family Dwelling-Highest Density) District on a 3 acre tract of land located on the east side of Major Drive, as described on Exhibit "A" and as shown on Exhibit "B" attached hereto, in Beaumont, Jefferson County, Texas is hereby granted to Seventh-Day Adventist Church of Beaumont, their legal representatives, successors and assigns for that certain tract described on Exhibit "A" attached hereto and made a part hereof for all purposes, subject to the following conditions: 1) All drainage shall be directed west to S. Major Drive; and 2) Phase II parking lot shall be constructed at the time of the construction of the church (Phase 1); and 3) The tract is to be subdivided according to Chapter 24, City Codes. Section 2. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit "C" and made a part hereof for all purposes. Section 3. Notwithstanding the site plan attached hereto, the use of the property hereinabove described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Phelan and wife, Katherine Huey Phelan, unto Michael A. Phelan Trustee, by deed dated February 7, 1975, and recorded in Volume 1974, Page 238 of the Deed Records of Jefferson County, Texas said 3.0000 acre tract being more particularly described by metes and bounds as follows: BEGINNING at a 1" iron pipe found in the west line of that certain 154.10 acre tract, said point being in the east right-of-way line of F.M. 364 (Major Drive), and bearing North 00 deg. 17 min. 37 sec. West 1847.53 feet from a 5/8" iron rod found for the southwest corner of Lot 1, Block 2 of the Final Plat of Willow Creek One, as recorded in Volume 12, Page 95 of the Map Records of Jefferson County, Texas; THENCE NORTH 89 deg. 41 min. 37 sec. East along and with the south lines of Lots 1, 2, 3, 4 and 5, Block 2 of said subdivision for a distance of 407.18 feet to a 1" iron pipe found for the northwest corner of this tract, said point being a re-entrant corner to Lot 5, Block 2 of said subdivision; THENCE SOUTH 00 deg. 17 min. 37 sec. West for a distance of 407.18 feet from the east right-of-way line of F.M. 364 (Major Drive) for a distance of 320.94 feet to a 5/8" iron rod set for the southeast corner of this tract; THENCE SOUTH 89 deg. 41 min. 37 sec. West for a distance of 407.18 feet to a 5/8" iron rod set for the southwest corner of this tract, said point being in the east right-of-way line of F.M. 364 (Major Drive); THENCE NORTH 00 deg. 17 min. 37 sec. West with the east right-of-way line of F.M. 364 (Major Drive) for a distance of 320.94 feet to the PLACE OF BEGINNING, containing 3.0000 acres of land, more or less.
