WHEREAS City Council awarded a bid in the amount of $58,250 to Martin Van
Clark Roofing and Flooring on September 29, 1998 for furnishing and installing carpet and
vinyl tile in the Beaumont Public Library; and,
WHEREAS, Martin Van Clark Roofing and Flooring was notified of the bid and given
ten days to supply certificates of insurance and performance and payment bonds, and;
WHEREAS, Martin Van Clark Roofing and Flooring submitted the required
certificates of insurance but requested additional time to secure performance and payment
bonds; and
WHEREAS, Martin Van Clark Roofing and Flooring was given an additional two
weeks, Martin Van Clark Roofing and Flooring has yet to furnish the required bonds; and
WHEREAS, Orange County Building Materials, Inc. was the second low bidder in
the amount of$69,000 for furnishing all labor, equipment, materials and supplies for the
removal and replacement of carpet and vinyl floor tile in the Beaumont Public Library;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT Martin Van Clark Roofing and Flooring has failed to perform on the bid awarded to
them September 29, 1998, therefore this contract is canceled and the bid submitted by
Orange County Building Materials, Inc. in the amount of$69,000 for furnishing all labor,
equipment, materials and supplies for the removal and replacement of carpet and vinyl
floor tile in the Beaumont Public Library Beaumont is accepted by the City of Beaumont.
