WHEREAS, the City Council of the City of Beaumont deems it necessary that improvements to Concord Road from Interstate 10 to East Lucas be located, constructed, widened, extended and maintained; and, WHEREAS,the City Council has found that a public necessity exists requiring the location, construction widening, extension and maintenance of said street on the hereinafter described property; and, WHEREAS, the City Council deems it necessary to acquire the hereinafter described interests in and to the hereinafter described property for said location, construction and widening, extension and maintenance of said street, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, the City of Beaumont,through its duly authorized representatives, has negotiated in good faith with the owners of the hereinafter described land and has been unable to agree with such owners of such property as to the fair market value thereof and damages, if any and further negotiationsfor settlement have become futile and impossible; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Attorney be and he is hereby authorized and directed to file or cause to be filed against all owners of the following parcel of land, and all claimants of any interest therein, proceedings in Eminent Domain to acquire fee simple title for said purposes,in and to the said parcel of land described in Exhibit"A" attached hereto and made a part hereof, the parcel of land being situated in Beaumont, Jefferson County, Texas. Williams Survey, Abstract No. 385, Jefferson County, Texas which was conveyed to George T. Norman by deed recorded in Volume 772, Page 478 of the Deed Records of Jefferson County, Texas; said 0.040 acre parcel being described by metes and bounds as follows: BEG iINNI EN'G at a 1 inch iron rod found in the southwest line of Concord Road for the northerly corner of said Norman tract and being the most northerly corner of the herein described parcel; THENCE South 40° 50' 58" East with the southwest line of Concord Road for a distance of 91.00 feet to a point for the easterly corner of said Norman tract and the most easterly corner of the herein described parcel and from which a found 1 inch iron pipe bears North 09° 13' 29" East a distance of 1.18 feet; THENCE South 51° 34' 09" West with the southern line of said Norman tract for a distance of 18.12 feet to a point in the most southerly corner of the herein described parcel; THENCE North 43* 55' 35" West for a distance of 12.59 feet to a point for corner; THENCE North 44° 01' S5" West for a distance of 68.08 feet to a point in the northwest line of said Hamilton tract for the most westerly corner of the herein described parcel; THENCE North 25" 54' 02" East with the northwest line of said Norman tract for a distance of 24.55 feet back to the point of beginning and containing 0.040 acres(1753.1 sq. ft.) of land. The bearings recited herein are based on Texas Plane Coordinate System, Lambert Projection, South Central Zone. All bearings, distances and acreage are surface. Exhibit "A"
