HomeMy WebLinkAboutRES 98-214 RESOLUTION NO. 9�-a/:Z WHEREAS, the City Council of the City of Beaumont deems it necessary that improvements to Concord Road from Interstate 10 to East Lucas be located, constructed, widened, extended and maintained; and, WHEREAS, the City Council has found that a public necessity exists requiring the location, construction widening, extension and maintenance of said street on the hereinafter described property; and, WHEREAS, the City Council deems it necessary to acquire the hereinafter described interests in and to the hereinafter described property for said location, construction and widening, extension and maintenance of said street, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated in good faith with the owners of the hereinafter described land and has been unable to agree with such owners of such property as to the fair market value thereof and damages, if any and further negotiations for settlement have become futile and impossible; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Attorney be and he is hereby authorized and directed to file or cause to be filed against all owners of the following parcel of land, and all claimants of any interest therein, proceedings in Eminent Domain to acquire fee simple title for said purposes, in and to the said parcel of land described in Exhibit "A" attached hereto and made a part hereof, the parcel of land being situated in Beaumont, Jefferson County, Texas. Ainsworth Addition in the James Drake Survey,Abstract No. 18, Jefferson County, Texas which was conveyed to Jack Fisher by deed recorded Volume 1913, Page 19 of the Deed Records of Jefferson County, Texas; said 0.034 acre parcel being described by metes and bounds as follows: BEGINNING at a 5/8 inch iron rod found in the northeast line of Concord Road for the northwesterly corner of said Lot 9 of Block 1 of the C.H. Ainsworth Addition, plat of'which is recorded in Volume 4, Page 115 of the Map Records of Jefferson County, Texas and being the northwesterly corner of the herein described parcel; THENCE North 510 49' 52" East with the northwest line of said Lot 9 for a distance of 30.21 feet to a point for the northeasterly corner of the herein described parcel; THENCE South 45' 11' 37" East for a distance of 44.75 feet to a point for corner; THENCE South 46° 42' 07" East for a distance of 5.76 feet to a point in the southeast line of said Lot 9 for the southeasterly corner of the herein described parcel; THENCE South 51° 57' 27" West with the southeast line of said Lot 9 for a distance of 29.95 feet to a 2 inch pipe in concrete found in the northeast line of Concord Road for the southwesterly corner of said Lot 9 and the southwesterly corner of the herein described parcel; THENCE North 45° 40' 21" West with the northeast line of Concord Road for a distance of 50.47 feet back to the point of beginning and containing 0.034 acres (1502.7 sq. ft.) of land. The bearings recited herein are based on Texas Plane Coordinate System, Lambert,projection, South Central Zone. All bearings, distances and acreaze are surface EXHIBIT "A"
