WHEREAS, Bruce A. Craig has requested that the City of Beaumont grant a
License to Encroach onto the City's fifteen-foot wide utility easement for property located
at 6255 Daisy Drive, for a wood deck and a concrete pool deck encroaching 12.0 feet for
a distance of 35.0 feet, a concrete pool encroaching 6.0 feet for a distance of 17.5 feet,
a wood fence encroaching 1.5 feet for a distance of 69.0 feet along the rear of the property
and 15.0 feet for a distance of 1.0 foot on either side of the lot and a metal storage building
encroaching 8.56 feet for a distance of 9.44 feet into the fifteen foot utility easement at the
rear of the property, as shown in Exhibit "A" attached hereto and made a part hereof for
all purposes; and,
WHEREAS, City staff has expended considerable time and effort in investigating
the effect of such encroachment upon the City and utilities serving the same; and,
WHEREAS, it appears that it would be equitable to allow such encroachment at this
time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute a Licenses to Encroach
with a wood deck and a concrete pool deck encroaching 12.0 feet for a distance of 35.0
feet, a concrete pool encroaching 6.0 feet for a distance of 17.5 feet, a wood fence
encroaching 1.5 feet for a distance of 69.0 feet along the rear of the property and 15.0 feet
for a distance of 1.0 foot on either side of the lot and a metal storage building encroaching
8.56 feet for a distance of 9.44 feet into the fifteen foot utility easement at the rear of his
property at 6255 Daisy Drive, as shown in Exhibit "A" attached hereto and made a part
hereof for all purposes.
