WHEREAS, on February 18, 1997, the City Council of the City of Beaumont,
Texas, awarded a contract to Excavators & Constructors, Inc. in the amount of
$386,537.08 for the 23rd Street Pavement Widening Project; and
WHEREAS, during the course of the project Change Order No. 1 is required
in the amount of$46,223.17 as described in Exhibit "A" attached hereto;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby authorized, to execute a Change Order No.
1 in the amount of$46,223.17. The project, as stated above, be and the same is herein
accepted and the City Manager be and he is hereby authorized to make final payment in
the amount of$46,330.67 to be paid to Excavators & Constructors, Inc.

2. Adjust the estimated quantities to reflect quantities actually used in completing project.
