WHEREAS, on Monday, April 7, 1997, bids were received for the construction of
a fourteen (14) acre solid waste disposal cell at the City's landfill as shown:

..Foster Wheeler, USA Corporation Houston, TX $1,123,232.40
Brystar Contracting, Inc. Beaumont, TX $1,126,290.00
Associated Environmental Services, Inc. Kingwood, TX 1 $1,163,110.00
and,
WHEREAS, Foster Wheeler Environmental Corporation, Houston, Texas, submitted
the low bid in the amount of$1,123,232.40; and,
WHEREAS, it was initially recommended that the bid submitted by Foster Wheeler
Environmental Corporation, should be accepted and the contract awarded to Foster
Wheeler Environmental Corporation; and
WHEREAS, questions have been raised regarding the addendum submitted by
Foster wheeler and information submitted by Brystar which changed their selection of the
liner installer which has caused reasonable doubt concerning which is the lowest and best
bid meeting specifications; and
WHEREAS, Section 271.027 of the Texas Local Government Code allows
governmental entities to reject any and all bids; and
WHEREAS, if the bids are rejected by the Council, the bid specifications will be
revised to remove any potential misunderstandings relating to addendums, irregularities
and exceptions, the City would then advertise and rebid the contract;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City reject all bids, advertise and rebid the contract
PASSED BY THE CITY COUNCIL of the City of Beaumont this the r. day of
01997.
