BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute an amended contract
for the Henry Homberg Municipal Golf Course substantially in the form attached hereto
as Exhibit "A" and made a part hereof for all purposes.

AMENDMENT TO HENRY HOMBERG MUNICIPAL
GOLF COURSE OPERATION AND MAINTENANCE CONTRACT
This Agreement is made and entered into this day by and between the City of
Beaumont, a municipal corporation of the State of Texas (herein called "City") and Ronnie
Pfleider, a professional golfer domiciled in Jefferson County, Texas (herein called
"Pfleider') in order to amend the Agreement executed on the 15th day of December, 1994
between City and Pfleider for the operation of the Henry Homberg Municipal Golf Course
located at Tyrrell Park in Beaumont, Texas and owned by City. For and in consideration
of the terms and conditions herein and mutual promises contained herein City and Pfleider
agree as follows:

That paragraph 9 of the Agreement described above is hereby amended to read as
foI lows:
"9. During the term of this contract Pfleider shall pay the City of Beaumont
$2,500 per month plus 5% of the gross receipts collected by Pfleider in the
operation of the Henry Homberg Municipal Golf Course subject to a minimum
annual payment of$60,000. The term "gross receipts" is defined to exclude
revenue related to sales taxes and wholesale trading. Pfleider shall keep
and maintain a complete and detailed accurate set of books and records of
daily entry accounting for receipts related to the operation of the Henry
Homberg Municipal Golf Course and such books and records shall be
available for examination by City at any and all reasonable times. Pfleider
shall promptly pay as it becomes due and payable all other indebtedness,
obligation or other amounts owing or incurred by him under this contract.

The remainder of the Contract described above is hereby ratified and republished
as if copied verbatim herein.
