WHEREAS, on March 21, 1995, by City Council authorized the City Manager to
enter into a contract with Excavators & Constructors, Inc. for the construction of the
Liberty/Laurel Phase II Project in the amount of$5,541,628.82; and,
WHEREAS, Change Order No. 1 for $42,391.60 and Change Order No. 2 for
$19,846.00 were created to increase the Contract amount to $5,603,866.42; and,
WHEREAS, Change Order No. 3 and Final is being requested to increase the
contract amount by $127,822.44 to reflect the quantities actually used during the
construction of the project;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute Change Order No. 3
and Final, as stated above, with Excavators & Constructors, Inc. The project as stated
above be and the same is herein accepted and the City Manager be and he is hereby
authorized to make final payment in the amount of$267,588.48.
