HomeMy WebLinkAboutRES 96-163 1 R E S O L U T I O N JEFFERSON COUNTY APPRAISAL DISTRICT Resolution No. qi ► Approval of Office Site for Jefferson County Appraisal District In Accordance With Section 6 . 051(b) of the Property Tax Code WHEREAS, the Jefferson County Appraisal District adopted Resolution #96-12 at their June 20, 1996 meeting approving the acquisition of land and construction of an office building; and, WHEREAS, Section 6 . 051(b) of the Property Tax Code mandates that this action be approved by three-fourths of the taxing entities entitled to vote on this matter, NOW, THEREFORE, BE IT RESOLVED by the governing body of the el'' ,l � ��d �c n �d n�� to approve the actions of the (Na de of Taxing Entity) Jefferson County Appraisal District Board of Directors in acquiring land and constructing an office building as outlined in JCAD Resolution #96-12 which is attached to and made a part of this resolution. ADOPTED, this the 912� day of 1996 . �r ATTEST: 1 R E S O L U T I O N JEFFERSON COUNTY APPRAISAL DISTRICT Resolution No. 96-12: Office Site - Acquisition of Land and Construction of Building for District Office WHEREAS, the Jefferson County Appraisal District received its notification that the lease arrangement with the Port Neches-Groves ISD for office space has been cancelled effective April 3, 1997; and, WHEREAS, it is necessary for the Jefferson County Appraisal District to find a new office location, NOW, THEREFORE, BE IT RESOLVED by the Jefferson County Appraisal District Board of Directors to purchase the land legally described as that certain 262' (street frontage) X 416' (depth) lot located on the Westerly side of Fourth Street, City of Beaumont, lying between the "Fina site" and residential development to the North and out of Block 33, M.C. Cartwright Addition to the City of Beaumont, Jefferson County, Texas at a purchase price of $50,000 (FIFTY THOUSAND AND N01100 DOLLARS) . BE IT FURTHER RESOLVED to construct a building at a cost not to exceed $840,000 (EIGHT HUNDRED FORTY THOUSAND AND N01100 DOLLARS) on the land authorized for purchase above under an intergovernmental contract with Jefferson County as approved by the Board on June 20, 1996, a copy of which is attached to and made a part of this resolution. BE IT FURTHER RESOLVED that the costs of other available alternatives to this proposal are attached to and made a part of this resolution. 1 Resolution No. 96-12 Page 2 of BE IT FURTHER RESOLVED that the Chief Appraiser shall notify the presiding officer of each governing body entitled to vote on this matter in accordance with Section 6.051(b) of the Property Tax Code, and this action shall not be considered approved unless three-fourths of those taxing entities adopt resolutions approving this proposed action on or before the 30th date after receiving said notification from the Chief Appraiser. Sherman, Chairman Board of Directors Jefferson Co Appraisal Dist ATTEST: Eugene Landry, Secretary Board of Directors Jefferson Co Appraisal Dist 1 STATE OF TEXAS INTERLOCAL GOVERNMENTAL CONTRACT Jefferson County and Jefferson COUNTY OF JEFFERSON County Appraisal District KNOW ALL MEN BY THE PRESENTS: WHEREAS, the Jefferson County Appraisal District has received legal notice to vacate the building where it conducts its current operations, and; WHEREAS, the Jefferson County Appraisal District performs a vital governmental service which requires adequate physical facilities, and; WHEREAS, the Jefferson County Appraisal District has determined that the most cost effective option available at this time to replace its physical facility is by construction of a new facility, and; WHEREAS, Jefferson County is able to provide engineering, architectural and other services in a timely and cost effective manner, and; WHEREAS, Jefferson County is capable of participating in the financing of a proposed building suitable to meet the needs of the Appraisal District to the benefit of the citizens of Jefferson County, and; WHEREAS, Chapter 791 of the Texas Government Code provides that governmental entities, including Jefferson County and the Jefferson County Appraisal District, may enter into interlocal contracts for the benefit of the public; IT IS therefore agreed by and between Jefferson County, Texas, hereinafter "County, " and the Jefferson County Appraisal District, hereinafter "Appraisal District, " as follows : County agrees to construct a building for Appraisal District operations according to plans and specifications to be prepared by County and subject to Appraisal District approval on real property owned by Appraisal District according to the following terms and conditions : Obligations of Jefferson County 1 . County shall provide services necessary to the construction of a building of approximately 16, 800 square feet including such design and engineering services as may be necessary as determined by County. County shall be responsible for construction of said building according to design and specifications mutually agreed upon by County and Appraisal District. County, at its sole option, may enter into such contracts as it determines may be necessary to accomplish construction. 3. County shall be responsible for the design, engineering, and construction of parking facilities suitable to the purposes of the building. 4. While it is mutually understood that time is of importance in the completion of this project, County does not guarantee a date of completion and there is no offset, penalty, or other compensation based upon the date of completion of the project. 5 . County will build the project on real property owned or to be acquired by Appraisal District and designated by the Appraisal District as the site for the project. Appraisal District owns or will acquire approximately 2 acres, more or less, which is adequate real property for the project. Obligations of Appraisal District 1 . Appraisal District shall pay County for the project as follows : a. $300, 000 cash payable to County on demand when construction begins . Construction begins on the date when site preparation work commences . b. The balance of construction costs shall be payable in equal, annual installments over 10 years on the first day of January beginning the first January following substantial completion of the project. These payments shall be secured by a lien on the real property and improvements which are the subject of this agreement. Appraisal District shall cause to be executed all documents necessary to the perfection of this lien. C. Appraisal District agrees to grant to County a first right of refusal to acquire the property and improvements if for any reason Appraisal District ceases to conduct its governmental functions in the project or if Appraisal District for any reason agrees to sell the real property and improvements . 1 Interlocal Governmental Contract Jefferson County and JCAD Page 3 The parties further agree that no obligation under this agreement shall commence unless Jefferson County first complies with Texas Government Code, Sec. 791 . 014 .
