HomeMy WebLinkAboutORD 95-76 ORDINANCE NO. - f ENTITLED AN ORDINANCE AMENDING CHAPTER 18 TO ADD A NEW SECTION 18-32 MAKING IT UNLAWFUL FOR A PERSON TO CARRY A HANDGUN OR OTHER FIREARM ONTO A VEHICLE OF THE BEAUMONT MUNICIPAL TRANSIT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. THAT Chapter 18 of the Code of Ordinances of the City of Beaumont be and the same is hereby amended to add a new section 18-32 to read as follows: 18-32. It shall be unlawful for a person intentionally, knowingly or recklessly to enter a vehicle owned or operated by the Beaumont Municipal Transit with a handgun or other firearm capable of being concealed on the person. It is a defense to prosecution that the actor possessed a firearm while traveling to or from the actor's place of assignment or in the actual discharge of duties as: 1. A peace officer; 2. A member of the Armed Forces or National Guard; 3. A guard employed by a penal institution; or, 4. A security officer commissioned by the Texas Board of Private Investigators or Private Security Agencies if: a. The actor is wearing a distinctive uniform; and, b. The firearm is in plain view. Section 2. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 3. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 4. That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of the City of Beaumont, Texas.
