ENTITLED AN ORDINANCE AMENDING ORDINANCE NO. 93-
61 TO ALLOW AN EIGHTEEN (18) MONTH EXTENSION FOR
DEVELOPMENT OF THE AREA DESIGNATED AS AREA "A" IN
THE SPECIFIC USE PERMIT GRANTED BY SAID ORDINANCE.
WHEREAS, on January 5, 1993, City Council approved Ordinance 93-2
issuing a specific use permit for professional offices on 7.92 acres located south of a 100'
wide Drainage District#6 ditch on the southwest portion of a 15.8 acre tract located within
a 22.58 acre tract of land described as Tract 6 out of Tract 55, Tax Roll Plat SPA H.
Williams Survey, Abstract 56, Beaumont Jefferson County, Texas; and
WHEREAS on October 26, 1993, City Council approved Ordinance 93-61
amending the specific use permit issued by Ordinance 93-2 to reduce the number of
buildings from 16 to 13 on an 8.67 acre tract with four of the buildings lying north of the
100' wide ditch; and,
WHEREAS, the specific use permit issued by Ordinance 93-2 is due to
expire on October 26, 1995; and
WHEREAS, the current record owner, Dowlen Development Company,
wishes to extend the time period for development of the portion of the specific use permit
designated as Area "A" only, said area containing 1.40 acres and located at the southwest
corner of the 8.67 acre tract and north of and abutting Wellington Place and east of and
abutting Dowlen Road, for a period of eighteen (18) months; and,
WHEREAS, the Planning and Zoning Commission of the City of Beaumont
considered the issuance of an amended specific use permit to Dowlen Development
Company, its legal representatives, successors, and assigns, to extend the time period for
development of the property designated as Area "A" for eighteen (18) months; and,
WHEREAS, the City Council is of the opinion that the amendment of such
specific use permit is in the best interest of the City of Beaumont and its citizens; and
WHEREAS, all conditions necessary for amendment of a specific use permit
have been met and a specific use permit to allow an eighteen (18) month extension for
development of Area "A" only, containing 1.40 acres located north of and abutting
Wellington Place and east of and abutting Dowlen Road heliport in Beaumont, Jefferson
County, Texas, should be granted:
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That Ordinance 93-61 be amended to allow an eighteen (18) month
extension for the development of property designated, in the existing specific use permit,
as Area "A" only to Dowlen Development Company, its legal representatives, its
successors, and assigns for that certain tract described in Exhibit "A" attached hereto and
made a part hereof for all purposes. The specific use permit shall become null and void
as to the remaining property upon expiration of the permit on October 26, 1995.
Section 2.
That the amended specific use permit herein granted is expressly issued for
and in accordance with each particular and detail of the site plan attached hereto as
Exhibit "A" and made a part hereof for all purposes.

Section 3.
Notwithstanding the site plan attached hereto, the use of the property
hereinabove described shall be in all respects subject to all of the applicable regulations
contained in Ordinance 89-30 and the regulations contained in Chapter 30 of the Code of
Ordinances of the City of Beaumont, Texas, as amended.
