WHEREAS, on August 15, 1995 City Council enacted Resolution No. 95-201
authorizing a contract with Norman Highway Constructors, Inc. in the amount of
$8,200,817.98 for the West Lucas Widening Project; and,
WHEREAS, during the installation of conduit at West Lucas and Gladys Streets,
Southwestern Bell encountered water and soil contaminated with gasoline; and,
WHEREAS, the Texas Natural Resource Conservation Commission initiated a
remediation program which has caused Norman Highway Constructors, Inc. to change its
work schedule; and,
WHEREAS, Norman Highway Constructors, Inc. has requested payment for
materials that were ordered and stockpiled for this section of the project at an estimated
cost of $115,000; and,
WHEREAS, City Council is of the opinion that the modification of the existing
agreement allowing for the payment of materials on hand is necessary and desirable;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT City Manager be and he is hereby authorized to execute an agreement to modify the
contract on the West Lucas Project with Norman Highway Constructors to allow for the
payment of certain materials on hand in the estimated amount of $115,000.
