WHEREAS, Jack R. King has requested that the City of Beaumont grant a License
to Encroach on a seven and one-half foot utility easement at the rear of his residence at
80 Ruth Drive, being Lot 7, Block 10, Russell Place Fourth Addition, for a wood frame
building on a slab is encroaching 7.13 feet for a distance of 23.33 feet into the easement,
as shown in Exhibit "A" attached hereto and made a part hereof for all purposes; and,
WHEREAS, City staff has expended considerable time and effort in investigating
the effect of such encroachment upon the City and utilities serving the same; and,
WHEREAS, it appears that it would be equitable to allow such encroachment at this
time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute a Licenses to Encroach
with Jack R. King for a wood frame building on a slab is encroaching 7.13 feet for a
distance of 23.33 feet onto a seven and one-half foot utility easement located on his
property at 80 Ruth Drive, being Lot 7, Block 10, Russell Place Fourth Addition, as shown
in Exhibit "A" attached hereto and made a part hereof for all purposes.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 61,1,,l day of
1996.
