HomeMy WebLinkAboutRES 96-21 RESOLUTION NO. � WHEREAS, the City Council of the City of Beaumont deems it necessary that improvements to FM 364/Major Drive from Highway 105 to State Highway 124 be located, constructed, widened, extended and maintained; and, WHEREAS, the City Council has found that a public necessity exists requiring the location, construction widening, extension and maintenance of said street on the hereinafter described property; and, WHEREAS, the City Council deems it necessary to acquire the hereinafter described interests in and to the hereinafter described property for said location, construction and widening, extension and maintenance of said street, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated in good faith with the owners of the hereinafter described land and has been unable to agree with such owners of such property as to the fair market value thereof and damages, if any and further negotiations for settlement have become futile and impossible; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Attorney be and he is hereby authorized and directed to file or cause to be filed against all owners of the following parcel of land, and all claimants of any interest therein, proceedings in Eminent Domain to acquire fee simple title for said purposes, in and to the said parcel of land described in Exhibit "A" and shown in Exhibit "B" attached hereto and made a part hereof, the parcel of land being situated in Beaumont, Jefferson County, Texas. Highway 364 and same being in the south line of I.ot . 7 , Block 7 of said Wescalder Fig Acres Subdivision and being located North 870 01 ' 23" East a distance of 799 .49 feet from a concrete -marker found for the southwest corner of said I,ot 7 , Block 7; THENCE North 880 01 ' 23" East with grantors north line and the south line of said Lot 7 a distance of 69 .71 feet to a iron rod found for corner in the existing west right of way line of F. M. Highway 364; THENCE South 020 58 ' 25" East with the existing west right of way line for F. M. Highway 364 and grantors east line a distance of 807.40 feet to a point for grantors southeast corner; THENCE South 870 01 ' 40" West with grantors south lire a distance of 44. 55 feet to a iron rod with cap set for corner in the proposed west right of way line for F. M. Highway 364; THENCE North 050 37 ' 37" West with said proposed Crest right of tray line a distance of 414. 56 feet to a Type II right of way marker set for the P. C. or beginning of a curve with a central angle of 020 46 ' 45" to the left and a radius of 5799 . 58 feet; THENCE in a northerly direction with said proposed west right of way line on said curve to the left a distance of 281'. 31 feet to a Type II right of way marker set for the P. T. or end of said curve, the chord for said curve is North 040 14 ' 15" West and 281 . 28 feet in length; EXHIBIT "A" THENCE North 020 50 ' 52" West with said proposed west right of way line a distance of 113. 28 feet to the place of BEGINNING.
