ENTITLED AN ORDINANCE SETTING RESIDENTIAL AND SMALL COMMERCIAL RATES FOR ENTEX, INC.; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. WHEREAS, on September 2, 1994, Entex, Inc., a NORAM Energy Company, filed an application with the City of Beaumont for an increase in rates for residential and small commercial customers; and, WHEREAS, the rate increase proposed by Entex, Inc., would provide additional annual revenue of $1,543,510 from the Beaumont Distribution System; and, WHEREAS, the City has studied the proposed rate increase; and, WHEREAS, a public hearing has been conducted; and, WHEREAS, the rates established herein will produce additional annual revenues for Entex, Inc., from its Beaumont Distribution System in the approximate amount of$733,771; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. THAT Entex, Inc., a NORAM Energy Company, is hereby authorized to place into effect within the Beaumont Distribution System the rate schedules attached hereto labeled Exhibit "A" and Exhibit 'B". Section 2. The rates established herein shall go into effect for the first billing cycle after January 1, 1995. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. PASSED BY THE CITY COUNCIL of the City of Beaumont this the day of 1994. - Mayor - ENTEX RATE SHEET RESIDENTIAL SERVICE RATE SCHEDULE NO. 1759-2 APPLICATION OF SCHEDULE This schedule is applicable to customers receiving gas for uses usual in a home through a single meter serving a single family dwelling and its related structures. Natural gas supplied hereunder is for the individual use of the customer at one point of delivery and shall not be resold or shared with others. NET MONTHLY RATE $11.00 per bill;plus $0.43942 per 100 cubic feet for all natural gas used MINIMUM MONTHLY BILL $11.00 PAYMENT Monthly bills are due and payable within ten(10)days from the date of bill. PURCHASED GAS ADJUSTMENT PROVISION The above net monthly rate per unit sold is predicated upon a price of gas purchased for resale hereunder of $3.4002 per Mcf To the extent that ENTEX's price of gas to be purchased (adjusted to correct any prior variations from actual costs)for resale hereunder increases or decreases, said net monthly rate shall be adjusted up or down to reflect changes in such cost of gas per unit sold. For purposes of calculating said adjustment, it shall be proper for ENTEX to determine its cost of gas from its several suppliers on the basis of a logical geographical area. ENTEX will not include in the purchased gas adjustment computation an unaccounted for gas expense of more than 5% of the purchase cost. Such determination shall be made for each twelve month period ending in June. Any amount collected in excess of this limitation attributable to the unaccounted for gas expense shall be utilized to reduce the cost of purchased gas during the ensuing twelve months. If ENTEX receives any refunds of any increased cost of purchased gas that have been passed on under this provision, a refund shall be made to customers served by this rate schedule. APPLICABLE TAXES PROVISION In addition to the payments provided for above, the customer shall reimburse the Company for the customer's proportionate part of any payments made to any governmental authority covering any tax, charge, impost, assessment or fee paid under any law, ordinance or agreement and any increase of any such tax, charge, impost, assessment or fee (except ad valorem and net income taxes) imposed against the Company or which directly affects the Company's cost of operations. To reflect any changes in the payments made to any governmental authority covering any such tax, charge, impost, assessment or fee (except ad valorem and net income taxes) in effect on January 6, 1995, the billing hereunder may be increased or decreased by an appropriate percentage adjustment sufficient to adjust for the change or changes in the aforementioned taxes or fees above or below the January 6, 1995 levels. Service under this schedule shall be furnished in accordance with the Company's General Rules and Regulations. EXHIBIT "A" ENTEX RATESHEET COMMERCIAL SERVICE RATE SCHEDULE NO. SC-1759-2 APPLICATION OF SCHEDULE This schedule is applicable to customers using gas for purposes other than residential whose consumption in any month is less than 150,000 cubic feet. When a customer uses in excess of 150,000 cubic feet in any month, the customer shall be billed on the applicable large volume rate schedule. Natural gas supplied hereunder is for the individual use of the customer at one point of delivery and shall not be resold or shared with others. NET MONTHLY RATE $15.00 per bill;plus $0.51137 per 100 cubic feet for all natural gas used MINIMUM MONTHLY BILL $15.00 PAYMENT Monthly bills are due and payable within ten(10)days from the date of bill.
