ENTITLED AN ORDINANCE ORDERING A GENERAL
ELECTION TO BE HELD IN THE CITY OF BEAUMONT ON
THE 6TH DAY OF MAY, 1995, AS PROVIDED BY LAW, FOR
THE PURPOSE OF ELECTING WARD COUNCILMEMBERS FOR
WARDS I, H, III AND IV; PROVIDING FOR PLACES WHERE
SUCH ELECTION SHALL BE HELD; APPOINTING OFFICERS
TO PRESIDE OVER SAID ELECTION;APPOINTING AN EARLY
VOTING BALLOT BOARD FOR EARLY VOTING; ORDERING
A RUNOFF ELECTION IF NECESSARY TO BE HELD ON THE
20TH DAY OF MAY, 1995; PROVIDING FOR JOINT ELECTION
WITH THE BEAUMONT INDEPENDENT SCHOOL DISTRICT
AND THE PORT OF BEAUMONT NAVIGATION DISTRICT;
PROVIDING FOR SEVERABILITY AND PROVIDING FOR
REPEAL.
WHEREAS, under the provisions of the Charter of the City of Beaumont and the laws of
the State of Texas relating thereto, a regular general election is required to be held in the City of
Beaumont on May 6, 1995. The election shall be for the positions of Ward Councihnembers I, IL
III and IV.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That in accordance with the provisions of the Charter of the City of Beaumont and the laws
of the State of Texas relating thereto, there shall be held in the city of Beaumont on May 6, 1995,
a regular municipal election for said city for the purpose of electing Ward Councilmembers for
Wards I, H, III and IV.

Section 2.
That legally qualified voters residing within the corporate limits of the City of Beaumont
shall be entitled to a vote at said election.
Section 3.
That said election shall be held in the City of Beaumont between the hours of 7:00 a.m. and 7:00
p.m. at the places listed in Exhibit "A" attached hereto and made a part hereof for all purposes and
the persons whose names appear in Exhibit "A" are appointed presiding judges and alternates for
the respective voting boxes with authority to select and appoint clerks.

The presiding judge for each election precinct shall appoint 2 clerks and the City Clerk may
appoint as many additional clerks as are deemed necessary for the proper conduct of the election.
Section 4.
That said election shall be held and the qualifications of those voting thereat shall be
controlled by the provisions of the Texas laws governing elections.
Section 5.
That notice of said election shall be given by publishing said notice as set out herein in a
newspaper of general circulation in this city and county one (1) time, not more than twenty-five
(25) days nor less than ten (10) days before said election. Said notice shall be in the following
form:

"NOTICE OF A GENERAL MUNICIPAL ELECTION IN THE CITY OF BEAUMONT FOR
THE PURPOSE OF ELECTINGWARD COUNCILMEMBERS FOR WARDS I, II, III AND IV."
"Notice is hereby given that a general municipal
election, as provided by the Charter of the City of
Beaumont and the statutes of the State of Texas, will be
held in the City of Beaumont on the 6th day of May,
1995, from 7:00 a.m. to 7:00 p.m. for the purpose of
electing Ward Councilmembers for Wards I, II, III and
IV."
Copy of said notice shall be filed with the County Clerk of Jefferson County, Texas, and
another copy shall be posted on a bulletin board in the office of said County Clerk at least twenty
(20) days prior to said election.
Section 6.
That the official ballot for the registering of the vote of the voters shall be as follows:

Section 7.
That an electronic voting system, as described by Title 8 of the Texas Election Code, shall
be used for said election and the following are hereby appointed officers of said election to serve
Central Counting Station which is hereby established at the Jefferson County Mid-County
Building: Manager of the Central Counting Station, Byron Broussard; Tabulation Supervisor, Bob
Crane; Presiding Judge of the Central Counting Station, Rosemarie Chiappetta. The official ballot
cards and ballot labels, respectively, for the election shall be prepared in accordance with the
Texas Election Code. Early voting shall be conducted by a clerk for Early Voting, namely
Rosemarie Chiappetta, the City Clerk, and the place in which the early voting by personal
appearance shall be conducted is designated at the City Hall, Room 125, 801 Main Street,
Beaumont, Texas, 77701. Early voting ballot applications and ballots voted by mail shall be sent
to the City Clerk's Office, P. O. Box 3827, Beaumont, Texas, 77704. Said clerk shall keep said
office open for at least eight (8) hours between 8:00 a.m. and 5:00 p.m. on each day for early
voting which is not a Saturday, a Sunday, or an official State holiday; provided, however, except
as authorized by Section 85.005(a), Texas Election Code, said clerk shall not permit anyone to
vote early by personal appearance on any day which is not a regular working day for the clerk's
office, and under no circumstances shall she permit anyone to vote early by personal appearance
at any time when her office is not open to the public.
Early votes by personal appearance and by mail shall be counted by an early voting ballot
board consisting of a presiding judge and three clerks and the City Clerk my authorize as many

additional clerks as are deemed necessary. Dolores Lawless, 495 Yorktown, is hereby appointed
Presiding Judge of the Early Voting Ballot Board and she shall appoint the clerks.
Section 8.
That in accordance with the laws of the State of Texas, a runoff election, if necessary to
elect any Ward Councilmember, is ordered to be held on the 20th day of May, 1995, between the
hours of 7:00 a.m. and 7:00 p.m., to be held at the same voting locations and with the same
election officers and judges as the general election.
Section 9.
That notice of the runoff election, if necessary to elect any Ward Councilmember, shall be
given by publishing said notice as set out herein in a newspaper of general circulation in this city
and county one (1) time, not earlier than the 30th day or later than the 10th day before election
day. Said notice shall be in the following form:
"NOTICE OF A RUNOFF ELECTION IN THE CITY OF
BEAUMONT FOR THE PURPOSE OF ELECTING A
COUNCILMEMBER FOR WARDS I, II, III OR IV."
"Notice is hereby given that a runoff election, as provided by Charter
of the City of Beaumont and the statutes of the State of Texas, will be
held in the City of Beaumont on the 20th day of May, 1993, from
7:00 a.m. to 7:00 p.m. for the purpose of electing a Councilmember
for Wards I, II, III, or IV."
Copy of said notice shall be filed with the County Clerk of Jefferson County, Texas, and
another copy shall be posted on a bulletin board in the office of said County Clerk not later than
the 15th day prior to said election.

Section 10.
The election shall be held jointly with the Trustee Election of the Beaumont Independent
School District and the Commissioners Election for the Port of Beaumont Navigation District. The
Beaumont Independent School District will hold an election jointly with the City of Beaumont in
nineteen (19) election precincts as set out in the Order calling such election for two trustees for
the Beaumont Independent School District. The Port of Beaumont will elect two commissioners
in the precincts as set out in the election order passed by the Port of Beaumont Navigation District.
The election shall be held in accordance with the following terms of agreement between the City
of Beaumont, the Beaumont Independent School District and the Port of Beaumont Navigation
District:
a) The expenses of the election within joint precincts shall be divided
with each governmental entity paying an equal share of said expenses.
b) Single ballot forms shall be used which shall contain the
Councilmember positions, BISD trustee positions and the Port of
Beaumont Navigation District commissioner positions.
c) The herein-named election officers shall conduct the elections in said
election precincts.
d) Records for all elections shall be combined.
e) One set of ballot boxes and stub boxes for all elections shall be used.
f) Election returns shall be made on joint forms but the City Council of
the City of Beaumont shall canvass the returns of the General
Municipal Election.
g) The City Clerk of the City of Beaumont is designated custodian of all
records and of the voting ballots.

Section 11.
A copy of this ordinance, both in the English language and in the Spanish language,
signed by the Mayor of the City of Beaumont, Texas, and attested by the City Clerk of said city,
shall constitute the notice ordering said election and the City Clerk is directed to cause a copy of
this ordinance, signed by the Mayor and attested by her, to be posted at the City Hall in the city
of Beaumont, Jefferson County, Texas, said positing to be not less than twenty days prior to said
election and to cause a copy of this ordinance to be published on the same day in each of two
successive weeks in some newspaper of general circulation in the City of Beaumont, said
publication to be made in accordance with State law, the first such publication to be made not less
than fourteen days before the date of said election.
Section 12.
This ordinance shall be finally passed on the date of its enactment and shall take effect
immediately upon its passage and signature by the Mayor. The City Clerk is hereby authorized
to attest to same and to affix the seal of the City of Beaumont hereto.
Section 13.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason be held
to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such
end the various portions and provisions of this ordinance are declared to be declared to be
severable.

Section 14.
All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the
conflict only.

Distrito Escolar independiente Beaumont y la eleccion del Puerto de Na-
vegaci6n Puerto de Beaumont. bl Distrito .Escolar -ndependiente Beaumont
tendra eleccion unida con la Ciudad de Beaumont e n dieci:nueve (19) dis-
tritos electorales como expuesto en urden decretando tal eleccion por
dos fideicomisarios para el Distrito Escolar Independiente Beaumont. El
Puerto de Navegacion Puerto de Beaumont elegira a dos comisarios de los

por el Mayor de la Ciudad de ieaumont, Texas y atestdda por la Escribana
de dicha Ciudad est� diri ida a ser pegada en el Ayuntamiento de la Ciudad
de Beaumont, Ccndado de t1jefferseo, Texas, y dicho pegando a ser no nenos
que veinte d as antes de dicha elecci6n y a causar a cue una copia de esta
