ENTITLED AN ORDINANCE CANVASSING THE RETURNS OF THE REGULAR CITY ELECTION HELD IN THE CITY OF BEAUMONT ON THE 7TH DAY OF MAY, 1988 FOR THE PURPOSE OF ELECTING A MAYOR AND TWO ( 2 ) COUNCIL MEMBERS-AT-LARGE AND REQUIRING THE CITY OF BEAUMONT TO COLLECT OR CAUSE TO BE COLLECTED ALL :RESIDENTIAL GARBAGE TWO (2 ) TIMES EACH WEEK; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. WHEREAS, the City Council of the City of Beaumont, in session, duly called the regular city election to be held on the 7th day of May, 1988, and the election returns of the votes cast in said election were canvassed for the following officials and for the passage of the twice weekly garbage collection ordinance: For the officer for the office of Mayor; For the officer for the office of Councilman- at-Large; For the officer for the office of Councilman- at-Large; For the Ordinance for twice weekly garbage collection service; WHEREAS, after duly canvassing said returns, the City Council found that the votes cast at said election for the several candidates for said offices and for the garbage collection ordinance were as follows: For Mayor: Votes John Adams 1 ,626 15. 40% Maury Meyers 8, 932 84. 60% For Councilman-at-Large: Andrew P. Cokinos 6,624 40.78% Roberto C. Flores 1 , 920 11 .82% Anthony "Tony" Sacker 1 ,451 8.93% Duwayne Herrmann, Jr. 727 4.48% Bob Lee, Jr. 5,522 33 .99% For the Ordinance 6,485 65.69% Against the Ordinance 3,387 34.31 % NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . THAT the results of said regular City election be, and the same are hereby, declared to have been as herein set out, and the following named persons were elected to the following offices and the twice weekly garbage collection ordinance was passed: For Mayor: Maury Meyers For Councilman-at-Large: Andrew P. Cokinos For Councilman-at-Large: Bob Lee, Jr. The City Council of the City of Beaumont further finds that notice of said election was duly and properly given as required by law and provided in the ordinance calling for said election, and that said election was duly and regularly held and returns thereof were duly and regularly made by the proper officials of said election and in all things according to law. Section 2. That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular person, or to a particular set of circumstances, should for any reason be held invalid, such invalidity shall in no way affect the remaining portions of this ordinance and to such end the various portions and provisions of this ordinance are declared to be severable. - 2 - Section 3 . That all ordinances and parts of ordinances in conflict herewith are hereby repealed. PASSED BY THE CITY COUNCIL of the City of Beaumont this the day of _ _, 1988. Mayor - - 3 -
