HomeMy WebLinkAboutORD 93-24 ORDINANCE NO. 3-.2 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO COMMUNITY CEMETERIES, INC. TO ALLOW EXPANSION OF AN EXISTING CEMETERY LOCATED WEST OF PINE STREET AND NORTH OF HALE STREET ON A 2.26 ACRE TRACT OUT OF TAX PLAT D-20 IN THE A. WILLIAMS SURVEY ZONED RS (RESIDENTIAL SINGLE FAMILY DWELLING DISTRICT) BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, the City Council for the City of Beaumont desires to issue a Specific Use Permit Community Cemeteries, Inc. to allow expansion of an existing cemetery located west of Pine Street and north of Hale Street on a 2.26 acre tract out of Tax Plat D-20 in the A. Williams Survey zoned RS (Residential Single Family Dwelling District) Beaumont, Jefferson County, Texas; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That all conditions necessary for issuance of a specific use permit have been met and a specific use permit to Community Cemeteries, Inc. to allow expansion of an existing cemetery located west of Pine Street and north of Hale �-9.3-a �/ Street on a 2.26 acre tract out of Tax Plat D-20 in the A. Williams Survey zoned RS (Residential Single Family Dwelling), Beaumont, Jefferson County, Texas, Community Cemeteries its legal representatives, successors and assigns for that certain tract described on Exhibit "A" attached hereto and made a part hereof for all purposes, subject to the above conditions. Section 2. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit 'B" and made a part hereof for all purposes. Section 3. Notwithstanding the site plan attached hereto, the use of the property hereinabove described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. CitY , of Beaumont May 21 , 1993 'Mayor - City Council Members cc : City Attorney, City Manager , City Clerk Reference : Main Agenda dated April 27, 1993 Item 1 An Ordinance Authorizing A Specific Use Permit To Allow Expansion Of An Existing Cemetery For Property Located West Of Pine Street And North Of Hale Street . On May 19, 1993 another meeting was held with Mr . W. H . Taft and residents of Morningside and Hale Street to work out some agreement that would be acceptable to both parties . They feel the following amendments will produce a win-win situation to this ordinance . I . Community Cemeteries Inc . (CCI ) will Place a fence , 8 ft . in height , starting from Memorial Garden I continuing around to Hale Street . 2 . A brick fence shall be installed , similar to what is presently in front of Memorial Garden I , extending to the corner of Pine and Hale and then connecting to the 8 ft . fence on Hale Street . 3 . There shall be no graves placed within 25 ft . of fence located on section S 00" 53 ' 30"E that is 93 . 75 ft . in length . 4 . One ( 1 ) gate 8 ft . x 12 ft . with electric remote opener centered at N 0014" 13 11W of sanitary sewer easement shall be installed . 5 . Slats are to be similar in design to Memorial Garden I existing fence . 6 . CCI will plant red-tip phoetenia hedges bordering item 1 . With these amendments attached to this ordinance , we the residents of Morningside and Hale Street and Mr . W.H . Taft President of Community Cemeteries Inc . wish that council will unanimously approve this agreement . Once again participants involved in this matter would like to thank the Mayor and Council Members for their patience and tolerance in resolving this problem.
