ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO ALLOW AN OFFICE PARK FOR PROFESSIONAL OFFICES ON 7.92 ACRES LOCATED WITHIN A 22.58 ACRE TRACT OF LAND DESCRIBED AS TRACT 6 OUT OF TRACT 55, TAX ROLL PLAT SP-1, H. WILLIAMS SURVEY, ABSTRACT 56, BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, the Planning and Zoning Commission of the City of Beaumont considered the issuance of a specific use permit to allow an office park for professional offices on 7.92 acres located south of a 100' wide Drainage District #6 ditch on the southwest portion of a 15.8 acre tract located within a 22.58 acre tract of land described as Tract 6 out of Tract 55, Tax Roll Plat SP-1, H. Williams Survey, Abstract 56, Beaumont, Jefferson County, Texas, to James Gonzales, Trustee, his legal representatives, successors, and assigns for that certain property hereinafter described; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That all conditions necessary for issuance of a specific use permit have been met and a specific use permit to allow an office park for professional offices on 7.92 acres located south of a 100' wide Drainage District #6 ditch on the southwest portion of a 15.8 acre tract located within a e -�F 3 -Z % --5 ,9 22.58 acre tract of land described as Tract 6 out of Tract 55, Tax Roll Plat SP-1, H. Williams Survey, Abstract 56, Beaumont, Jefferson County, Texas, is hereby granted to James Gonzales, Trustee, his legal representatives, successors and assigns for that certain tract described on Exhibit "A" attached hereto and made a part hereof for all purposes. Section 2. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit "B" and made a part hereof for all purposes. Section 3. Notwithstanding the site plan attached hereto, the use of the property hereinabove described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Post Office Box 5492 Beaumont, Texas 77706 Dear Mr. Whiteley: The City Council acted on your request regarding the Dowlen tract on Dowlen Road and Wellington by passing two ordinances on January 5, 1993. Ordinance No. 93-1 changed the zoning classification of certain property from RS (Residential Single Family Dwelling) to RM-H (Residential Multiple Family Dwelling-Highest Density District) and NC (Neighborhood Commercial District). The Exhibit "A" attached to the ordinance depicts the changes. Ordinance No. 93-2 was a specific use permit on a 7.92 acre tract which was part of the property rezoned to RM-H. The permit is for offices. The City Council, however, made it a condition for granting the specific use permit that driveway access to the office park shall be from Dowlen Road. No drive cuts shall be allowed from Wellington. This is noted on pages 6 and 7 of the City Council minutes of January 5, 1993. A copy of these minutes is being sent to you under separate cover in another letter relating to the Major Street and Highway Plan. The site plan as now on file with the ordinance in the City Clerk's Office does not reflect the conditions set by Council on January 5.
